<br />," j ~ <br />"j ~ } <br /> <br />TUESDAY <br /> <br />SEPTEMBER 29, 1981 <br /> <br />Commission that the petition be granted, Council directed the vacating and abandonment <br /> <br />of said section through adoption of the following ordinance, all members--with the <br /> <br />exception of Vice Mayor Cole, who abstained and who raised a question as to the <br /> <br />development of the property before Council's final action on the petition as well as <br /> <br />the question as to the status of the right-of-way proposed to be abandoned or being <br /> <br />abandoned in the event the property is sold sometine in the future--voting affirma- <br /> <br />tively on the motion to grant the request, effecting same by the following ordinance: <br /> <br />WHEREAS, Patricia B. Byrum, Albert G. Byrum, Jr., Emma S. Richmond, and <br />Marion D. Richmond have filed a petition requesting the vacating and <br />abandonment of one-half of the north side of Brown Street which abuts <br />Lot No. 3 (with reservation of nine feet of right-of-way for Ellsworth <br />Street) situated on the east side of Ellsworth Street, as shown on "Map <br />of Property Belonging to the J. D. Aaron Estate, in M.B. 2, Page 169, <br />Henry County Circuit Court Clerk's Office"; and <br /> <br />WHEREAS, the Martinsville Planning Commission, having duly considered <br />this request and having conducted a duly-advertised public hearing <br />thereon, has recommended that the petition be granted; and <br /> <br />WHEREAS, Nartinsville City Council on September 29, 1981, conducted a <br />duly-advertised public hearing on this matter, at which hearing no <br />objections to the petition were registered; now, therefore, <br /> <br />BE IT ORDAINED by the Council of the City of Martinsville, Virginia, <br />in regular meeting assembled this 29th day of September, 1981, that <br />one-half of Brown Street abutting the aforesaid Lot No.3, subject to <br />the reservation of utility easements and subject to the reservation of <br />nine feet of right-of-way for Ellsworth Street, as shown on Plat of <br />Survey prepared for petitioners by J. A. Gustin & Associates under <br />date of April 14, 1981, and as marked or outlined in red on said Plat <br />of Survey, be, and the same is hereby declared, vacated and abandoned. <br /> <br />In tentative acceptance of a recommendation from the Planning Commission that Council <br />approve a petition seeking a P-2 Professional zoning of properties located between <br />Morgan Street and Commonwealth Boulevard and extending from the Martinsville Athletic <br />Club site to Bethel Lane, as filed by Doctors Jack H. Eberhart, John W. Selman, and <br />Paul A. Holyfield, Council called for a duly-advertised public hearing to be conducted <br />on this petition at Council's forthcoming October 27th meeting. <br /> <br />Council acknowledged receipt of the annual report (for the year ended June 30, 1981) <br />of the City's Industrial Development Authority, as presented by its Chairman, Mr. Irving <br />M. Groves, Jr., President and Chief Executive Officer of the Piedmont Trust Bank. The <br />
