Implementation: <br /> <br />The conditions described herein shall be declared in writing <br />to the City Council by the City Manager, upon the advice of the <br />Department of Public Works. Enforcement, thereafter, of all <br />prohibitions, sanctions and surcharges shall be the responsibility <br />of the City Manager and his designees. <br /> <br />Upon motion, duly seconded and unanimously carried, Council adopted the <br /> <br />following ordinance (as placed on first reading July 14, 1981), increasing <br /> <br />the current assessment of one dollar ($1.00) to two dollars ($2.00) as <br /> <br />part of the cost attached to each civil action filed in the local courts, <br /> <br />for support of the City's Law Library. <br /> <br />WHEREAS, Section 42.1-70 of the CODE OF VIRGINIA (1950, and as <br />amended) has been amended to provide that any city (within the <br />Commonwealth of Virginia) may, through its governing body, assess <br />as part of the costs, incident to each civil action filed in the <br />courts located within its boundaries, a sum not in excess of two <br />dollars ($2.00); now, therefore, <br /> <br />BE IT ORDAINED by the Council of the City of Martinsville, <br />Virginia, in regular session held July 28, 1981, that the sum of <br />two dollars ($2.00) shall be assessed, as part of the costs, <br />incident to each civil action filed in the courts located within <br />the boundaries of the City of Martinsville, Virginia; and <br /> <br />BE IT FURTHER ORDAINED that such assessment shall be collected, <br />remitted, and disbursed according to, and shall otherwise be <br />subject to, the provisions of the aforesaid Section 42.1-70 of <br />the CODE OF VIRGINIA (1950, and as amended); and <br /> <br />BE IT FURTHER ORDAINED that the provisions of any prior ordinance <br />in conflict with the provisions of the foregoing ordinance, to <br />the extent of such conflict, be, and the same hereby are, <br />rescinded and repealed; and <br /> <br />BE IT FURTHER ORDAINED that, an amergency existing, this ordinance <br />shall be in effect on and after August 1, 1981. <br /> <br />Also, upon motion (duly seconded and unanimously carried), Council adopted <br /> <br />the following ordinance (as placed on first reading July 14, 1981) amending <br /> <br />the purchasing section(s), viz., Article III of Chapter 6, of the City Code: <br />
