<br />I,) <br />I-..,J <br /> <br />TUESDAY <br /> <br />APRIL 26, 1983 <br /> <br />opportunity for receipt of future Virginia Commu- <br />nity Development Block Grant Funding; <br /> <br />2) to be a co-recipient of a 1982 Community Develop- <br />ment Planning Assistance Grant in the amount of <br />$16,104 with the Town of Rocky Mount and Counties <br />of Franklin, Henry, and Patrick; <br /> <br />3) as principal applicant, to accept this 1982 Commu- <br />nity Development Planning Assistance grant and to <br />authorize its City Manager, Don R. Edmonds, to <br />serve as Chief Administrative Officer to enter <br />into contract with the Department of Housing and <br />Community Development; and <br /> <br />4) to designate the West Piedmont Planning District <br />Commission to carry out all work activities in its <br />behalf as described in the City of Mart insvi lle' s <br />proposal; and <br /> <br />BE IT FURTHER RESOLVED by said Council that a copy of this resolution <br />be transmitted to the Town of Rocky Mount; Counties of Franklin, <br />Henry, and Patrick; West Piedmont Planning District Commission; and <br />the Virginia Department of Housing and Community Development. <br /> <br />By letter dated April 13, 1983, and in person, Mr. Benjamin R. Gardner, Attorney at Law <br /> <br />and Counsel for Mrs. Margaret S. Trent (of 1015 Morningside Lane), petitioned the Council <br /> <br />to amend Section 3-4 of the City Code to allow the keeping of goats and sheep in the City, <br /> <br />subject to compliance with all restrictions set forth, as applicable to other animals and/ <br /> <br />or livestock permitted thereunder. Mr. Gardner contended that the distinction in the City <br /> <br />Code between "goats" and other animals is arbitrary and capricious, creating distinctions <br /> <br />as well as attributing criminal penalties thereto which are neither fair nor constitutional. <br /> <br />Mr. Gardner's petition, apparently, was prompted by a recent warrant of arrest and charge <br /> <br />filed against his client by City authorities for the keeping of livestock "...in the City <br /> <br />without obtaining a permit--To wit: one goat", it later being discovered that the Health <br /> <br />Department can not issue a permit for the keeping of a goat or goats and sheep because they <br /> <br />are excluded from the terms and conditions of said Section 3-4. Mr. Gardner further <br /> <br />pointed out that Mrs. Trent's son (Kyle) is the actual owner of the "one goat", it being a <br />
