<br />~3 <br /> <br />TUESDAY <br /> <br />MARCH 8, 1983 <br /> <br />yet uncertain, although the one or two others whose drive-way improvements encroach upon <br /> <br />City right-of-way are agreeable if the City will bear the cost of relocating and/or <br /> <br />replacing these improvements, one of which involves a retaining wall at considerable <br /> <br />expense. In addition, Mr. Jerry Perdue, of 1008 Morningside Lane, contended that the <br /> <br />City is obligated to resolve a water run-off problem in front of his property, irregard- <br /> <br />less of whether curb-and-gutter is constructed. Mayor Cole, viewing the proposed project <br /> <br />as a general street improvement project (rather than merely a curb-and-gutter project), and <br /> <br />expressing his opinion that some fault lies with the City for having allowed encroaching <br /> <br />improvements upon the City's right-of-way along this street (which was annexed to the City <br /> <br />as of January 1, 1965), maintained that the City's administrative staff should study the <br /> <br />proposed project and determine what can be done to accommodate the petitioners and, in so <br /> <br />doing, if variances from the City's present policy are a stumbling block, what these <br /> <br />variances are and what can be done to justify them. City Manager Edmonds indicated, with <br /> <br />Council's concurrence, which was so expressed, that he and his staff will review the <br /> <br />project's problems and will identify alternatives and will report back thereon to Council, <br /> <br />meanwhile noting that to go beyond this point, i.e., to deviate from the City's established <br /> <br />policy by accepting less than the required 100% shared-cost participation and/or permitting <br /> <br />other variances would constitute a precedent-setting situation and ".....would be opening a <br /> <br />door we've never opened before." Council indicated that the 100% shared-cost question is to <br /> <br />be excluded from Mr. Edmonds' study and report. <br /> <br />In order to provide an opportunity for interested citizens and business firms to study and <br /> <br />comment, Council postponed action until its forthcoming March 22nd meeting on an ordinance <br /> <br />(as introduced February 22, 1983) which would increase fees for electric service by amending <br /> <br />Article X (Appendix D and Appendix E) of the City's Terms and Conditions for Electric <br /> <br />Service.
