<br />TUESDAY <br /> <br />JANUARY 25, 1983 <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF MARTINSVILLE, VIRGINIA, <br />THAT: <br /> <br />TITLE I <br /> <br />SECTION 101. Short Title. This Franchise Ordinance shall be known <br />and may be cited as the "Electric Franchise Ordinance". <br /> <br />SECTION 102. Definitions. A. For the purpose of this Franchise <br />Ordinance, the following terms, phrases, words, and their derivations <br />shall have the meaning given herein: <br />(1) "City" is the City of Martinsville, Commonwealth <br />of Virginia; <br />(2) "Company" is Appalachian Power Company, grantee of <br />rights under this Franchise Ordinance; and <br />(3) "Council" is the City Council of the City of <br />Martinsville. <br /> <br />B. When not inconsistent with the context, words used in the <br />present tense include the future, words in the plural number include the <br />singular number, and words in the singular number include the plural number. <br /> <br />C. The word "shall" is always in the mandatory sense. <br /> <br />SECTION 103. Grant of Franchise. A. The Company is hereby granted <br />the right, privilege, franchise and authority to construct, erect, operate <br />and maintain, in, above, under, across and along the streets, thoroughfares, <br />alleys, bridges and public places of the City, lines for the transmission <br />and distribution of electric energy either by means of overhead or under- <br />ground conductors, with all necessary or desirable appurtenances, for the <br />purpose of supplying electric energy: <br />(1) to its present customers within the City; and <br />(2) to residential, commercial, industrial and other <br />users beyond the limits of the City, <br />for light, heat, power or any other purpose or purposes for which electric <br />energy is now or may hereafter be used. <br /> <br />B. The right, privilege, franchise and authority granted by <br />subsection 103.A. shall not be exclusive, and the City reserves the right to <br />make similar grants to any person or corporation at any time. <br /> <br />SECTION 104. Users and Customers Under the Franchise Ordinance. The <br />Company shall have the right to furnish electric energy for lighting, heating, <br />and power purposes for its own use as well as the use of the following six of <br />its present customers located within the City, their successors or assigns: <br />(1) The Lester Group, Liberty Street; <br />(2) Sale Knitting Company, Franklin Street; <br />(3) Pulaski Furniture Corporation, East Church Street; <br />(4) Hooker Furniture Corporation, East Church Street; <br />(5) W. M. Bassett Furniture Compar;, Rives Road; and <br />(6) The Prillaman Company, Stultz Road. <br />
