a~ TUESDAY JULY 24, 1984 rezoning, Mayor Cole declared the public hearing closed; whereupon motion, duly seconded and unanimously carried, Council accepted the Planning Commission's recommendation and, in so doing, adopted the following ordinance amending the City's Zoning Map accordingly: BE IT ORDAINED by the Council of the City of Martinsville, Virginia, in regular meeting assembled this 24th day of July, 1984, that the Zoning Map of the City of Martinsville be--and is hereby--amended to the effect that Lots Nos. 12, 13, 25, and 26, situated off the east end of Valley- dale Drive and owned by L. D. Fisher, Jr., are hereby rezoned from "R-9 Residential" to "P-2 Professional". -, BE IT FURTHER ORDAINED by said Council that, an emergency existing, this ordinance shall be in force on and after July 25, 1984. Also, pursuant to duly-advertised public notice, Council conducted a public hearing on a petition filed by Brown's, Incorporated, (through Mrs. Mary Brown Mei), seeking the vacating and abandonment of that section of Nyack Road which lies between the north side of Wade Street and the southwest side of the Norfolk & Southern Railway Company's right- of-way, which petition carried the Planning Commission's recommendation for Council's approval (subject to two conditions hereinafter cited). There being no persons registering any objections to this petition, Mayor Cole declared this public hearing closed; whereupon motion, duly seconded and unanimously carried, Council accepted the Planning Commission's recommendation and, in so doing, adopted the following ordinance vacating said section of - Nyack Road, subject to the stipulations therein: BE IT ORDAINED by the Council of the City of Martinsville, Virginia, in regular meeting assembled this 24th day of July, 1984, that the section of Nyack Road situated between the north side of Wade Street and the south- west side of the Norfolk & Southern Railway Company's right-of-way be--and is hereby--vacated and abandoned, subject to (a) retention by the City of Martinsville of an easement for its existing power line at the present location and (b) preparation and recording of appropriate map(s) combining the portion of Nyack Road, hereby vacated and abandoned, with the adjacent properties of Brown's Incorporated. BE IT FURTHER ORDAINED by said Council that, an emergency existing, this ordinance shall be in force on and from July 25, 1984.
