<br />a~ <br /> <br />TUESDAY <br /> <br />JULY 24, 1984 <br /> <br />rezoning, Mayor Cole declared the public hearing closed; whereupon motion, duly seconded <br /> <br />and unanimously carried, Council accepted the Planning Commission's recommendation and, in <br /> <br />so doing, adopted the following ordinance amending the City's Zoning Map accordingly: <br /> <br />BE IT ORDAINED by the Council of the City of Martinsville, Virginia, in <br />regular meeting assembled this 24th day of July, 1984, that the Zoning <br />Map of the City of Martinsville be--and is hereby--amended to the effect <br />that Lots Nos. 12, 13, 25, and 26, situated off the east end of Valley- <br />dale Drive and owned by L. D. Fisher, Jr., are hereby rezoned from <br />"R-9 Residential" to "P-2 Professional". <br /> <br />-, <br /> <br />BE IT FURTHER ORDAINED by said Council that, an emergency existing, this <br />ordinance shall be in force on and after July 25, 1984. <br /> <br />Also, pursuant to duly-advertised public notice, Council conducted a public hearing on a <br /> <br />petition filed by Brown's, Incorporated, (through Mrs. Mary Brown Mei), seeking the <br /> <br />vacating and abandonment of that section of Nyack Road which lies between the north side <br /> <br />of Wade Street and the southwest side of the Norfolk & Southern Railway Company's right- <br /> <br />of-way, which petition carried the Planning Commission's recommendation for Council's <br /> <br />approval (subject to two conditions hereinafter cited). There being no persons registering <br /> <br />any objections to this petition, Mayor Cole declared this public hearing closed; whereupon <br /> <br />motion, duly seconded and unanimously carried, Council accepted the Planning Commission's <br /> <br />recommendation and, in so doing, adopted the following ordinance vacating said section of <br /> <br />- <br /> <br />Nyack Road, subject to the stipulations therein: <br /> <br />BE IT ORDAINED by the Council of the City of Martinsville, Virginia, in <br />regular meeting assembled this 24th day of July, 1984, that the section <br />of Nyack Road situated between the north side of Wade Street and the south- <br />west side of the Norfolk & Southern Railway Company's right-of-way be--and <br />is hereby--vacated and abandoned, subject to (a) retention by the City of <br />Martinsville of an easement for its existing power line at the present <br />location and (b) preparation and recording of appropriate map(s) combining <br />the portion of Nyack Road, hereby vacated and abandoned, with the adjacent <br />properties of Brown's Incorporated. <br /> <br />BE IT FURTHER ORDAINED by said Council that, an emergency existing, this <br />ordinance shall be in force on and from July 25, 1984. <br />
