S. Environmental Protection Agency pertaining to industrial dis- <br /> <br />charges into the City's sanitary sewer system. <br /> <br />Upon recommendation of the law firm of Ely, Ritts, Pietrowski & Brickfield (of Washing- <br /> <br />ton, D.C.), counsel for the'City of Martinsville and other Virginia wholesale purchasers <br /> <br />of electric energy from Appalachian Power Company under contracts, Council unanimously <br /> <br />adopted the following resolution which, as City Manager Edmonds pointed out, constitutes <br /> <br />a settlement agreement between the City of Martinsville, along with the other wholesale <br /> <br />purchasers, and Appalachian Power Company with regard to issues cited therein whereby, <br /> <br />in particular, a moratorium on wholesale rate increases (agreed to on April 28, 1983) <br /> <br />will be extended to January 1, 1985: <br /> <br />WHEREAS, on September 30, 1982, Appalachian Power Company ("APCo") <br />filed a rate increase request of $942,000 per year for the Cities <br />of Bedford, Danville, Martinsville, Radford, Richlands, and Salem <br />and Virginia Polytechnic Institute and State University with the <br />Federal Energy Regulatory Commission ("FERC"); and <br /> <br />WHEREAS, on November 30, 1982, FERC suspended the effective date <br />of this rate increase for five months, thereby allowing the new <br />rates to become effective on May 1, 1983, subject to refund after <br />a trial and final order; and <br /> <br />WHEREAS, on April 25, 1983, APCo and these customers agreed upon a <br />settlement which, among other things; <br /> <br />1. Reduced the proposed increase to approximately <br />$509,000 for the period of April 1, 1983, to <br />March 31, 1984; and <br /> <br />2. Prevented APCo from implementing another rate <br />increase before July 1, 1984; and <br /> <br />3. Left for further adjudication the issue of the <br />reasonableness of APCo's purchases of coal from <br />affiliated coal mining properties ("the reserved <br />issue"); and <br /> <br />WHEREAS, on May 2, 1984, the Public Service Commission of West <br />Virginia approved APCo's request to sell the majority of its <br />
