Each party to the contract will be responsible for its prorata <br />share of the operation and maintenance costs related to the diversion <br />facilities based upon a ratio of the quantity of sewage diverted by <br />each party to the total sewage flow which is diverted. Similarly, the <br />City will pay the Authority its prorata share of the operation and <br />maintenance costs related to the treatment plant based upon a ratio of <br />the quantity of City sewage diverted to and treated at the Authority's <br />Upper Smith River Plant to the total sewage flow treated by the said <br />Plant. <br /> <br />In view of the fact that the Authority and City have been negotiating <br />an Amendment to their 1974 Sewerage Service Agreement for two or three <br />years, we have enclosed a draft of a suggested Amendment reflecting the <br />above offer. Hopefully, this and the above will assist you and the <br />Council in understanding the Authority's proposal. We are prepared to <br />discuss the matter in greater detail with you and Council and to con- <br />tinue our negotiations in order to resolve this matter as expeditiously <br />as possible. <br /> <br />Although it has been understood, the Authority is prepared to provide <br />the financing for the construction of the required improvements in <br />question in accordance with the terms and conditions of the 1974 Agree- <br />ment and an appropriate Amendment thereto. <br /> <br />Further, the Authority is prepared to proceed immediately with the <br />design and construction of the Jones Creek Interceptor diversion and <br />force main facilities. In turn the City would be expected to pay its <br />share of such plans and specifications. In order to proceed in an <br />orderly fashion, the Authority will proceed upon notification of your <br />acceptance of this proposal. <br /> <br />~ <br /> <br />Because of your indicated pressing need for expanded capacity of waste- <br />water treatment, we respectfully suggest that this proposal of the <br />Authority be considered at the next meeting of City Council. An early <br />response is requested. <br /> <br />In an analysis of the PSA's response, City Manager Edmonds presented the following written <br /> <br />report: <br /> <br />The P.S.A. Board has rejected the City's April 11, 1984, letter or re- <br />quest by which to divert City sewage from the Jones Creek interceptor <br />line to the Authority's Upper Smith River Wastewater Treatment Plant. <br /> <br />This action is, as you know, contrary to the initial reactions to the <br />request which were made public by members of the Board and the P.S.A. <br />staff immediately following the Council's April 10 meeting. Having <br />received the letter, P.S.A. Chairman Hubbard was quoted in the April 16 <br />Bulletin as saying, "I don't see any large negatives in it. It's almost <br />right along the lines which we had been proposing." Executive Director <br />
