<br />ii ~) <br />ii ~, <br /> <br />TUESDAY <br /> <br />JANUARY 22, 1985 <br /> <br />amendments, Mayor Cole declared this public hearing closed; whereupon motion, duly <br /> <br />seconded, Council unanimously adopted same in the form of the following ordinance: <br /> <br />BE IT ORDAINED by the Council of the City of Martinsville, Virginia, in <br />regular meeting assembled this twenty-second day of January, 1985, that <br />Sections II and VIII of the Zoning Ordinance of the City of Martinsville, <br />Virginia, be--and are hereby--amended, as follows: <br /> <br />(1) To Section II (Definitions), add the following: <br /> <br />Rehabilitation Facility. A building or part thereof used as a <br />non-profit rehabilitation facility providing any opportunity for <br />personal adjustment to normal daily living for persons formerly <br />suffering from mental illness, alcoholism, or similar afflictions, <br />and who are generally considered as being capable of resuming a <br />normal living situation; provided, that the use of such facility <br />shall be solely for living purposes and shall not be used for <br />medical convalescing, medical treatment, psychiatric theraphy or <br />other such treatment other than general guidance and counseling. <br /> <br />(2) Amend sub-section C-9 of Section VIII to read as follows: <br /> <br />Residential-Custodial Care Facility. Facilities as described in <br />Section II (Definitions) may be allowed in the R-6 Residential, <br />P-l Professional, P-2 Professional, and C-3 Commercial Districts, <br />subject to this section. <br /> <br />For the purposes of this paragraph, the title "Residential- <br />Custodial Care Facility" shall mean any residential structure <br />operated either as a public or private facility for the main- <br />tenance or care of four (4) or more adults who are aged, infirm <br />or disabled, except (1) a facility or portion of a facility <br />licensed by the state board of health or the state hospital board, <br />but including any portion of such facility not so licensed; and <br />(2) the home or residence of an individual who cares for or main- <br />tains only persons related to him by blood or marriage. <br /> <br />(3) Amend sub-section C of Section VIII by adding, as item 10, the <br />fo llowing: <br /> <br />Rehabilitation Facility. Facilities as described in Section II <br />(Definitions) may be allowed in the P-l Professional, P-2 Pro- <br />fessional, and C-3 Commercial Districts, subject to this section. <br /> <br />In considering further certain proposed amendments to the City's Business-Professional- <br /> <br />Occupational License Tax Ordinance (1983), as accepted for introduction by Council at <br /> <br />its January 8th meeting, Council received from Acting City Manager George W. Brown a <br /> <br />substitute draft of an ordinance which incorporated all of the amendments as introduced <br /> <br />but proposed retention of the exemption and/or exclusion from local license taxation, <br /> <br />under certain conditions, the gross receipts of locally-based contractors derived from <br />
