56

TUESDAY, AUGUST 26, 1986

suggested that City Attorney Worthy's previously-proposed amendment to Section

5-39 be re-presented for Council's review and consideration; whereas Councilman

McClain noted that It is not Council's intention to enact regulations which can

not be enforced or might be a source of embarrassment for local police officers

attempting to enforce compliance with local ordinances. Upon motion, duly

seconded and unanimously carried, Council authorized the donating of certain

animals (held by the City's Dog Warden) to the local SPCA Chapter and, also,
accepted for introduction and first reading the proposed amendments to Sections
5-37 and 5-55 of the City Code.

Supplementing his June 10th report ......covering the cost of implementation of

the Smith Lake Road improvement project......, City Manager Brown presented--as

requested by Councll--a study report and cost of constructing an access road

from Smith Lake Road to the Souths ide recreation complex (estimated cost being

$40,110.00); however, because of possible generation of additional traffic and

the relatively high cost of the proposed access road, City Manager Brown recom-

mended that such a project not be undertaken at this time. In discussing this

report, members of Council while concurring with the findings and recommen-

dations therein, urged that every effort be made to expedite the TSM Project

and that Beaver Street revert to its former two-way status as soon as possible,

with usage of this street to be limited, as proposed by City Manager Brown.

Meanwhile, in response to inquiries from members of City Council regarding

acquisition of necessary right-of-way for a right-turn on the TSM Project and
