This resolution shall take effect immediately upon its <br />adoption. <br /> <br />Council also unanimously adopted the following resolution (directing that copies <br /> <br />thereof be forwarded to the City's representatives in the Virginia General Assembly) <br /> <br />in support of proposed House Bill No. 183 which, if enacted, would clarify questions <br /> <br />raised as to the interpretation by the Virginia Department of Highways & Transporta- <br /> <br />-. <br /> <br />tion of the word "maintenance" in Section 33.1-23.02 of the CODE OF VIRGINIA (1950, <br /> <br />and as amended) as well as revise current procedures for receipt of highway mainte- <br /> <br />nance payments by Virginia cities and towns: <br /> <br />WHEREAS, during the 1985 session of the General Assembly, House Bill <br />(HB) 1269 was passed pertaining to the allocation of funds for con- <br />struction and maintenance of the various systems of State highways, <br />including certain counties; and <br /> <br />WHEREAS, HB 1269 provides for the continuance of payments to cities <br />and certain towns for maintenance of certain highways as set forth <br />in said Bill; and <br /> <br />WHEREAS, the Virginia Department of Highways and Transportation under <br />said Bill, as described in Section 33.1-23.02 of the Code of Virginia, <br />is unduly restrictive in its interpretation of the term "maintenance"; <br />and <br /> <br />WHEREAS, the administrative interpretation of the term "maintenance" <br />precludes reimbursement for preventive maintenance, and betterment or <br />improvement of streets in the course of conducting normal maintenance <br />thereby restricting the eligibility of cities to receive proper reim- <br />bursement from the State for the maintenance of streets as provided <br />under HB 1269 and as set forth in Section 33.1-41.1, Code of Virginia; <br />now, therefore, <br /> <br />BE IT RESOLVED by the Council of the City of Martinsville, Virginia, <br />in regular meeting assembled that it hereby supports the following <br />Bill to amend Section 33.1-23.02, Code of Virginia, with respect to <br />the definition of the term "maintenance": <br /> <br />HOUSE BILL NO. 183 <br />OFFERED BY JOAN MUNFORD <br /> <br />A Bill to amend Section 33.1-23.02, Code of Virginia to alter pro- <br />cedures for receipt of highway maintenance payments by cities and <br />certain towns. <br />
