<br />4 7~ <br /> <br />TUESDAY, MARCH 10, 1987 <br /> <br />whereupon motion, duly seconded and unanimously carried, in acceptance of the <br /> <br />wishing to speak to this matter, Mayor Oakes declared the public hearing closed; <br /> <br />Planning Commission's recommendation (as revised or amended), Council authorized the <br /> <br />issuance of the required Special-Use Permit upon the condition that the project be <br /> <br />completed within five (5) years from the date of permit issuance. <br /> <br />Council also conducted a duly-advertised public hearing on Multitrade Group's <br /> <br />petition seeking the rezoning from M-l Industrial to M-2 Industrial those certain <br /> <br />properties in an area bounded on the east by Lester Street, on the south and <br /> <br />southwest by the right-of-way of Norfolk & Southern Railway {formerly the Carolina & <br /> <br />Inc. (and/or The Lester Group). As has been previously recorded in minutes of prior <br /> <br />Northwestern Railway), and on the north by property owned by Lester Lumber Company, <br /> <br />meetings of Council, petitioner seeks this property rezoning to enable petitioner to <br /> <br />construct and operate a plant which will generate steam and electric energy for <br /> <br />resale. There being no objections registered to the proposed property rezoning, <br /> <br />Council (by a vote of three-to-none, Councilman McClain abstaining because of a <br /> <br />Mayor Oakes declared this public hearing closed; whereupon motion and duly seconded, <br /> <br />possible conflict of interest) accepted the Planning Commission's recently-submitted <br /> <br />recommendation that the petition be approved and, in so doing, Council (also by the <br /> <br />Zoning Map by zoning the properties M-2 Industrial: <br /> <br />same vote of three-to-none) adopted the following ordinance which amends the City's <br /> <br />BE IT ORDAINED by the Council of the City of Martinsville, Virginia, in <br />regular meeting assembled this tenth day of March, 1987, that the Zoning <br />Map of the City of Martinsville, Virginia, be--and is hereby--amended to <br />the extent that those certain properties in an area bounded on the east by <br />Lester Street, on the south and southwest by Norfolk & Southern Railway <br />(formerly Carolina & Northwestern Railway) right-of-way, and on the north <br />by property owned by Lester Lumber Company, Inc., and/or The Lester Group, <br />are hereby rezoned from M-l Industrial to M-2 Industrial. <br /> <br />BE IT FURTHER ORDAINED by said Council that, an emergency existing, this <br />ordinance shall be in force on and after March 11, 1987. <br />
