<br />DAN RIVER ALCOHOL SAFETY ACTION PROGRAM <br />& <br />POLICY BOARD <br />BY-LAWS <br /> <br />ARTICLE I - NAME <br /> <br />The program serves the courts of the cities of Danville and Martinsville, and the <br />counties of Franklin, Henry, Patrick and Pittsylvania with respect to those persons <br />charged with or convicted of driving under the influence or other applicable offenses <br />under the Virginia Code, or requesting participation in any other ancillary programs <br />offered by the Program, shall be known as the Dan River Alcohol Safety Action Program <br />(Dan River ASAP). <br /> <br />The Board of this agency shall be known as the Dan River Alcohol Safety Action <br />Program Policy Board. <br /> <br />ARTICLE II - AUTHORITY <br /> <br />Danville City Council on July 13, 1976 authorized a feasibility study for establishment <br />ofa VASAP program through Resolution No. 76-7.1. The V ASAP project became <br />operational on November 1, 1977. The Dan River Alcohol Safety Action Program exists <br />pursuant to Articles of Agreement between the political subdivisions listed in Article I <br />and the Policy Board. This agreement implements House Bill 1662 as it created Chapter <br />601, Section 18.2-271.1 of the Code of Virginia, as amended, and as so provided, is a <br />public body with all the powers and duties granted to it by the Code of Virginia. <br /> <br />ARTICLE III - DEFINITIONS <br /> <br />"Program" <br />"Year" <br /> <br />means the Dan River ASAP Policy Board. <br />means any of the governmental subdivisions being <br />parties to the Articles of Agreement. <br />means the Dan River ASAP. <br />means a one year period, unless otherwise noted, a <br />one year period beginning July 1 and ending the <br />following June 30, and the fiscal year of the <br />program shall be such year. <br /> <br />"Board" <br />"Participating Jurisdiction" <br /> <br />ARTICLE IV - STATEMENT OF PURPOSE <br /> <br />The Program is a local court services program that shall strive to use community and <br />state services to reduce the problem of driving under the influence of alcohol and/or <br />drugs, in an effort to improve transportation safety both locally and statewide. In <br />conjunction with the regulations and policies of the Commission on V ASAP, the <br />Program shall identify and provide appropriate services to court-referred individuals <br />convicted of or referred for such offenses as Driving Under the Influence, Reckless <br />Driving, Illegal Use or Possession of Alcohol or other Drugs, and Habitual Offender <br />violations. The Program shall provide intervention in the form of education, training, <br />referral to treatment, as well as probation and monitoring services, and other programs as <br />may serve the needs of the participating jurisdictions. <br />
