,July 27, 2004 <br /> <br /> A regular, semi-monthly meeting of the Council of the City of Martinsville, <br />Virginia, was held on July 27, 2004, in Council Chamber, Municipal Building; beginning <br />at 7:30 P. M., with Mayor Joe Cobbe presiding. Council Members present included: <br />Joseph R. Cobbe, Mayor; Kimble Reynolds, Jr., Vice Mayor; and Council Members <br />James W. Clark, J. Ronald Ferrill, and Terry L. Roop. <br /> <br /> Following the invocation by Council Member Clark and Pledge to the American <br />Flag, Mayor Cobbe welcomed everyone to the meeting. <br /> <br /> Council considered adoption, on second reading, of Ordinance 2004-14 <br />amending Section 12-111 (b) of the City Code relating to reimbursement of expenses <br />incurred in DUI and other traffic accidents. Council Member Ferrill moved to adopt the <br />following Ordinance 2004-14, on second reading; the motion was duly seconded and <br />carried by the following roll call vote, with all members voting: Vote 5 - 0; Yeas (5) - <br />Clark, Cobbe, Ferrill, Reynolds, Roop; Nays (0) - None: <br /> <br /> BE IT ORDAINED by the Council of the City of Martinsville, <br /> Virginia, in regular session held on July 13, 2004 that Section 12-11 <br /> (b) of the City Code be amended to read as follows: <br /> <br /> Sec. 12-11. Violations of chapter generally; reimbursement of <br /> expenses incurred in responding to DUI and other traffic incidents. <br /> <br /> (b) Personal liability under this section for reasonable expenses of <br /> an appropriate emergency response shall not exceed $1,000 in the <br /> aggregate for a particular accident or incident occurring in such <br /> locality. In determining the "reasonable expenses," the City or the <br /> responding volunteer rescue squad may bill a flat fee of $250 or a <br /> minute-by-minute accounting of the actual costs incurred. As used <br /> in this section, "appropriate emergency response" includes all costs <br /> of providing law-enfomement, fire fighting, rescue, and emergency <br /> medical services. The provisions of this section shall not preempt or <br /> limit any remedy available to the Commonwealth, to the City or to <br /> any volunteer rescue squad to recover the reasonable expenses of <br /> an emergency response to an accident or incident not involving <br /> <br /> <br />
