June 8,2004 <br /> <br />provided, however, that an annual permit may be issued for dances held <br />and conducted in regularly established and licensed places used <br />principally for dances. <br />(b) Application for a permit required by this section shall be made in <br />writing on forms to be provided by the office of the city manager. The <br />nonrefundable fee for such application shall be Fifty Dollars ($50), payable <br />to the City Treasurer and collected contemporaneously with the <br />application. <br /> <br />Sec. 4-31. Same--Issuance or refusal; revocation. <br />(a) The city manager may issue or refuse to issue a permit applied for <br />under section 4-30 within ten (10) working days after inspection process is <br />completed, or he may cancel or revoke any such permit after it has been <br />issued, if he shall learn that the same was procured by fraud or false <br />representation or that the applicant has failed to comply with the <br />provisions of this article or the terms of the permit or has violated any <br />ordinance of the city or any laws of the commonwealth in connection with <br />the application for or the use of the permit, or for any other rsason which, <br />in the opinion of the city manager, will be detrimental to the public peace, <br />health or welfare. <br /> <br />Sec. 4-32. Special permit for operation between certain hours; <br />Sunday operation. <br />(a) It shall be unlawful for any person to maintain, conduct or operate any <br />public dance between the hours of 1:00 a.m. and 7:00 p.m., without <br />having first obtained a special permit from the city manager, application for <br />which shall have been made at least fifteen (15) working days in advance <br />of the date of such dance. <br /> <br />Council considered adoption, on second reading, of Ordinances 2004-10, 2004- <br /> <br />12, and 2004-13. Vice Mayor Roop moved to adopt, on second reading, Ordinance <br /> <br />2004-10 [Attachment A] amending Appendix A of the City's Terms and Conditions for <br /> <br />Electric Service; the motion was duly seconded and carried by the following roll call <br /> <br />vote, with all members voting: Vote 4 - 1; Yeas (4) - Cobbe, Ferrill, Roop, Teague; <br /> <br />Nays (1) - Dallas. Council Member Ferrill moved to adopt, on second reading, the <br /> <br />following Ordinance 2004-12 amending Chapter 18 - Solid Waste, Section 18-24 Fee <br /> <br />Schedule of the City Code; the motion was duly seconded and carried by the following <br /> <br /> <br />
