March 9, 2004 <br /> <br /> Council considered adoption, on first reading, of Ordinance 2004-5 amending <br />Section 12-11 of the City Code relating to reimbursement of expenses incurred in <br />responding to DUI and other traffic incidents. Eric Monday, City Attorney, stated that <br />the proposed ordinance is in response to legislation approved by last year's General <br />Assembly. Capped at $1,000, it will be initiated by the City Attorney and will not work <br />like other lien programs. Council Member Ferrill suggested to defer action to solicit <br />public input. Vice Mayor Roop said that he felt that if action is deferred, a precedent is <br />being set for all future ordinances and public hearings. Mayor Teague reviewed the <br />process of first and second readings. Council Member Ferrill moved to table this issue <br />until the next regular meeting; the motion was duly seconded and carried by the <br />following vote, with all members voting: Vote 4 - 1; Yays (4) - Cobbe, Ferrill, Roop, <br />Teague; Nays (1) - Dallas. <br /> <br /> Council considered adoption, on first reading, of Ordinance 2004-6 adding <br />Section 13-19.1 to Chapter 13 of the City Code relating to giving the police department <br />the authority to enforce trespassing on real property in the absence of the property <br />owner. Michael Rogers, Chief of Police, offered an example, stating that businesses <br />will benefit the most, especially during the summer. Council Member Ferrill moved to <br />table this issue until the next regular meeting; the motion was duly secOnded and <br />carried by the following vote, with all members voting: Vote 3 - 2; Yays (3) - Cobbe, <br />Ferrill, Roop; Nays (0) - Dallas, Teague. <br /> <br /> Council considered business from the floor.
