April 13, 2004 <br /> <br />110 <br /> <br />Council considered adoption, on second reading, of Ordinance 2004-6 adding <br /> <br />Section 13-19.1 to Chapter 13 of the City Code relating to giving the police department <br /> <br />the authority to enforce trespassing on real property in the absence of the' property <br /> <br />owner. Mr. Bartlett stated that he received no calls concerning this issue. Council <br /> <br />Member Dallas moved to adopt, on second reading, of the following Ordinance 2004-6; <br /> <br />the motion was duly seconded and carried by the following vote, with all members <br /> <br />present voting: Vote 4- 0: Yays (4) - Cobbe, Dallas, Ferrill, Roop; Nays (0) - None: <br /> <br />BE IT ORDAINED by the Council of the City of Martinsville, <br />Virginia, in Regular Session held on March 23, 2004, that Section <br />13-19.1 be added to Chapter 13 of the Martinsville Code to read as <br />follows: <br /> <br />Sec. 13-19.1. Designation of City Police Department <br />Any owner, lessee, custodian, or person lawfully in charge of real <br />property, as those terms are used in Code of Virginia § 18.2-119, <br />may designate the City Police Department as a "person lawfully in <br />charge of the property" for the purpose of forbidding another to go <br />or remain upon the lands, buildings or premises as specified in the <br />designation. Such designation shall be in writing, in a ~orm <br />approved by the City Police Department, and shall be kept on file <br />with the City Police Department. The City Police Department shall <br />enjoy exclusive discretion concerning (a) whether to exercise the <br />authority granted it as a result of such designation, (b) the manner <br />in which the authority is exercised, and (c) the assignment of an <br />individual police officer or officers to exercise it. <br /> <br />Council considered adoption of a Resolution recognizing April as Fair Housing <br /> <br />Month and expressing the City's pledge to provide equal housing opportunities for all <br /> <br />citizens. Mr. Bartlett stated that this is an annual task and requirement. Council <br /> <br />Member Dallas moved to adopt the following Resolution; the motion was duly seconded <br /> <br />and carried by the following vote, with all members present voting: Vote 4 - 0: Yays (4) <br /> <br />- Cobbe, Dallas, Ferrill, Roop; Nays (0) - None: <br /> <br /> <br />
