August 12, 2003 maintenance. Wayne Knox, Planning, Zoning, & Housing Manager, stated that the Commonwealth of Virginia will initiate the International Building Code on October 1, 2003. The three major changes of this Ordinance include (1) definitions define nuisance in more detail and areas that were not covered in the old ordinance are now regulated; (2) penalties are more enforceable, can be assessed by City Attorney or Building Official; and (3) procedure to abate - only one notice has to be sent or the property can be posted, if the nuisance exists on the same property more than once during a six-month period, only the initial notification has to be given to correct the violation. Council requested a work session to discuss a rental property maintenance program. A discussion ensued regarding the timing of Staff to act after notifications. John Sanders, of 308 Starling Avenue, requested a public hearing be held prior to adoption; Eric Monday, City Attorney, replied that a public hearing was not required. Council Member Dallas moved to adopt Ordinance 2003-12, on first reading; the motion was duly seconded and carried by the following vote, with all members voting: Vote 5 - 0; Yeas (5) - Cobbe, Dallas, Ferrill, Roop, Teague; Nays (0) - None. Public comments will be welcomed prior to the second reading at the next regular meeting. Council considered adoption of a Resolution authorizing the City Attorney to work with the Treasurer in the collection of delinquent real estate taxes. Council Member Ferrill moved to adopt the following Resolution; the motion was duly seconded and carried by the following vote, with all members voting: Vote 5 - 0; Yeas (5) - Cobbe, Dallas, Ferrill, Roop, Teague; Nays (0) - None: WHEREAS, the City of Martinsville requires the timely payment of taxes and other revenues due and owing to it; and
