~ 7

September 24, 2002

Nays (2) - Cobbe, Teague. Council requested to review similar properties with special
use permits.

Council considered conducting a Public Hearing and adopting an Ordinance on a
request by Troy E. Rakes to rezone 602 and 604 Rives Road, Tax Map ID 53(02) 14,
15, from R-9 Residential to C-1 Commercial and amend the proposed Land Use Plan to
indicate Commercial rather than the current designation of Residential. Mr. Hayfield
stated that the Planning Commission voted to recommend denial of this request. Mayor
Teague declared the Public Hearing open. Jim Beard, of 313 Oakdale Street, spoke in
opposition. Mr. Wolchko spoke, also, in opposition. Mayor Teague declared the Public
Hearing closed. David B. Worthy, City Attorney, stated that this request would be spot-
zoning, which is not allowed. Vice Mayor Roop moved to concur with the Planning
Commission's recommendation of denying the request; the motion was duly seconded
and carried by the following vote, with all members voting: Vote 5 - 0; Yeas (5) -
Cobbe, Dallas, Ferrill, Roop, Teague; Nays (0)- None.

Council considered business from the floor. Judge Charlie Stone stated that the
three District 21 judges have ordered the naming of the Martinsville Circuit Courtroom
the "Frank I. Richardson, Jr., Courtroom." In reading the actual order, he highlighted
Judge Richardson's 29 years of service, including the planning of the courtroom.
Council directed Staff to prepare a similar Resolution for presentation.

Wade Bartlett, Director of Finance, presented the financial reports for months

ending July 31,2002, and August 31,2002.
