Enclosure

Martinsville

September 9, 2002

The Honorable Mayor and City Council
City of Martinsvflle
Martinsville, Virginia

Council Members,

The Planning Commission, at a meeting on August 22, 2002, conducted a public
hearing on a request from Troy L. Rakes to rezone tax map parcels 52 (2) 00/14
and 52 (2) 00/15 from R-9 Residential to C-1 Commercial. The physical addresses are
602 & 604 Rives Road.

Staff recommendation and Commission majority opinion is that rezoning of these
properties could be considered as spot zoning. Additionally rezoning these two
properties to C-1 Commercial allows a number of uses that will not be compatible
with the surrounding residential properties.

The Commission determined that this rezoning should be denied as presented. The
Commission in it's continuing work on revision of the city zoning ordinance, shall
consider amendment of the R-6, R-9, and RP-1 zoning districts to allow certain personal
service uses by special use permit. Amendment approved, the Rakes beauty salon
proposal on Rives Road may be considered for approval by special use permit.

On September 3, 2002, following the staff report and discussion by the Commission,
the Commission vote was 4-1with one (1) abstention to recommend to City Council that
the rezoning amendment be denied as proposed. The Planning Commission
respectfully submits the above request for Council's further consideration.

Sincerely,

James Barnett, Secretary

Wayne D. P.
