148 <br /> TUESDA¥~ $~ptember 25~ 2001 <br /> <br />NOW THEREFORE, the parties to this Agreement hereby agree as follows: <br /> <br />The term of this Agreement shall be for a three (3) year period, commencing on July 1, 2003 and ending on <br />June 30, 2006. <br /> <br />The tipping fee throughout the term of this Agreement, which the County agrees to pay the City, shall <br />be fixed at $31.70 per ton. However, this fee may be adjusted by the City if, during the term of this <br />agreement, the City experiences an operational cost increase due to changes in federal or state <br />environmental or other laws/regulations affecting the disposal of solid waste. Documentation to <br />support any requested increase shall be provided to the County Administrator prior to the imposition <br />of any increase. The tipping fee of $31.70 shall apply only to the solid waste controlled by the Henry <br />County government through its system of green boxes, convenience centers, and public schools. The <br />tipping fee will apply to all material, including sludge, brought to the landfill by the Henry County <br />Public Service Authority. Waste tires, from any source, will be charged at the rate of $1.06 per tire, <br />or $106.00 per ton if hauled to the facility in bulk quantities. The tire disposal rate may change prior <br />to or during the Agreement period based on contract disposal costs. <br /> <br />2. The City will provide all operational services. <br /> <br />3. The operation of the City's Solid Waste Disposal Facilities shall be seven days a week in order to <br /> continue to accommodate the County's solid waste collection schedule. <br /> <br />The County agrees that it will assign and transfer to the City all of its rights, title, and interest in all <br />solid waste delivered to and accepted by the City at its facility. The City, as owner of the facility, <br />retains the right to reject any waste brought to the facilities which is not allowable or acceptable waste <br />as defined by the Solid Waste Management Regulations or which is otherwise a problem or threat to <br />the facility operation. <br /> <br />o <br /> <br />If during the above-stated contract period the City is forced to close it's landfill, the City will not be <br />held liable for the terms of this Agreement. The City will, if the County so desires, negotiate new <br />contract terms to ensure continuity of service. <br /> <br />6. Any special project requiring the disposal of construction and/or demolition debris in excess of 500 <br /> tons will be subject to a negotiated rate on a per-project basis. <br /> <br />7. Under the terms of this agreement, the City will accept up to 4000 tons annually of stabilized sewage <br /> sludge produced by the PSA or its contractor. <br /> <br />Upon closure of the City Landfill, the County will not be financially responsible for any activities <br />related to normal closure and post closure activities prescribed by EPA/DEQ regulations. The City is <br />currently in compliance with all financial assurance requirements set forth by DEQ for landfill closure <br />and post closure activities. <br /> <br />Council considered the Consent Agenda with the following items: <br /> <br /> <br />
