8 6-19 MARTINSVILLE CODE <br /> <br /> (b) If the person named in the notice referred to in subsection (a) above cannot be found <br />after diligent search, such notice shall be sent by registered or certified mail to the last known <br />address of such person and a copy of the notice shall be posted in a conspicuous place on the <br />premises. Such procedure shall be deemed the equivalent of personal notice. <br /> <br /> (c)' The failure, neglect or refusal of any person to comply with the terms of any notice given <br />him pursuant to this section shall constitute a misdemeanor punishable by a fine of not more <br />than one thousand dollars ($1,000.00). <br />(Ord. of 8-10-82, 88 3, 4, 10) <br /> <br />Sec. 6-20. Repair or removal by city generally. <br /> <br /> (a) Upon refusal or neglect of the person served with a notice pursuant to section 6-19 to <br />comply with the requirements of the order to abate the unsafe condition, the building official <br />shall proceed to order the necessary Work to be performed by city forces or by contract. He shall <br />send a bill for such work to the owner of the building within ten (10) days after completion of <br />the work. <br /> <br /> (b) If the bill referred to in subsection (a) is not paid within thirty (30) days from the date <br />of billing, the building official shall transmit a copy of the bill to the city treasurer, who shall <br />include such amount in the next regular tax bill of the owner. Such charges which remain <br />unpaid shall constitute a lien against the property in question and may be collected as all other <br />taxes and levies are collected. <br />(Ord. of 8-10-82, 8 9) <br /> State law reference--Authority for above section, Code of Virginia, 8 15.1-11.2. <br /> <br />Sec. 6-21.
