CITY OF MARTINSVILLE, VIRGINIA <br /> ORDINANCE NO. 2001-5 <br /> <br />7/10/01 Agenda <br />Item IV <br /> <br /> WHEREAS, the Virginia Board of Housing and Community Development by its order <br />entered on May 22, 2000, adopted the present edition of the Virginia Uniform Statewide <br />Building Code, which became effective on September 16, 2000, and, <br /> <br /> WHEREAS, Part 1II thereunder sets forth the scope, administration, and enforcement <br />procedures for the local option enforcement of the maintenance provisions of the USBC, and, <br /> <br /> WHEREAS, it is the desire of the Martinsville City Council to enforce the property <br />maintenance provisions of the USBC in their entirety, and to assign responsibility for the <br />enforcement of same to its Inspection Division as the local enforcing agency and the building <br />official as the building maintenance code official. <br /> <br /> NOW THEREFORE, BE IT ORDAINED by the Council of the City of Martinsville, <br />Virginia in regular session held on July 10, 2001 that the Inspection Division be, and it hereby is, <br />designated to act at the enforcing agency for the enforcement of the maintenance provisions of <br />the Virginia Uniform Statewide Building Code (USBC) and the therein referenced BOCA <br />National Property Maintenance Code (BNPMC) as duly amended and adopted by the Virginia <br />Board of Housing and Community Development under authority of {}36-98, Code of Virginia. <br />Enforcement shall be according to the USBC and the term of this ordinance. <br /> <br /> BE IT FURTHF-R ORDAINED that the enforcement procedure shall be instituted and <br />administered by the building maintenance code official in accordance with the provisions of the <br />USBC and that said building maintenance code official shall establish such procedures or <br />requirements as may be necessary, but not in conflict with the USBC, for administration and <br />enforcement of this ordinance. The procedures are to be approved by this Council. <br /> <br /> BE IT FURTHER ORDAINED that the local board of building code appeals is hereby <br />designated to hear appeals arising from the application of the maintenance provisions of the <br />USBC. <br /> <br /> BE 1T FURTHER ORDAINED that should any provision of this ordinance be declared <br />by the Courts to be unconstitutional or invalid, such decision not affect the validity of the <br />ordinance as a whole, or any part there of other than the part so declared to be unconstitutional or <br />invalid. <br /> <br /> BE IT FURTHER ORDAINED that ordinances numbered 95-10 and 97-13 heretofore <br />adopted by Council be, and they hereby are, revoked and rescinded in their entirety. <br /> <br /> BE 1T FURTHER ORDAINED that an emergency exists and that this ordinance shall <br />become effective on and after this date. <br /> <br /> <br />
