WORTHY CITY ATTORNEY · City of Martinsville VIRGINIA Item IV - Enclosure Revised ORDINANCE WHEREAS, Commonwealth Boulevard Associates, LLC, applied, pursuant to the provisions of §15.2-2006 of the Code of Virginia, to have vacated a public fight-of-way consisting of a road space 30 feet wide and approximately 500 feet long known as Townes Street located west of Franklin Street and north of Commonwealth Boulevard, as shown on City Tax Map 22(4&6), and, WHEREAS, notice of intention to vacate Townes Street has been published at least twice, with at least six days elapsing between the first and second publication, in a newspaper having general circulation in this locality, specifying the time and place of the hearing at which persons affected may appear and be heard, which hearing was held on February 27, 2001 by Martinsville City Council, and, NOW THEREFORE, BE IT ORDAINliD by the Council of the City of Martinsville, Virginia, in regular session held on February 27, 2001 that Townes Street as shown on Drawing S-1 prepared by the City Engineering Departmere on February 22, 2001, a copy of which is attached hereto, be, and it hereby is, vacated pursuant to the provisions of §15.2-2006 of the Code, as aforesaid, said vacation to take effect upon the payment of $9,300.00 by Commonwealth Boulevard Associates, LLC, to the City of Martinsville to purchase from said City the fight-of-way herein vacated, title to which thereby vested in Commonwealth Boulevard Associates, LLC, and, BE IT FLIRTHER ORDAINliD that a certified copy of this ordinance to vacate shall be recorded as deeds are recorded and indexed in the name of the City of Martinsville in the Clerk's Office of the Circuit Court of the City of Martinsville, Virginia.; ~-a~id 7~- .'
