<br />19~ <br /> <br />TUESDA); <br /> <br />AUGUST 23. 1960 <br /> <br />The regular semi-monthly meeting of the Council of the City of Martinsville, <br /> <br />Virginia, with Mayor John W. Shultz presiding, was held in the Council Chamber, <br /> <br />City Hall, Tuesday, August 23,1960, at 7:15 P.M., all members being present <br /> <br />with the exception of Councilman Clarence C. Donavant, viz., Mayor and Councilman <br />John W. Shultz; Vice-Mayor an d Councilman E. E. Stone; Councilman <br />Thomas J. Emrch; and Councilman J. Frank Wilson. <br /> <br />,- <br /> <br />After the invocation, Council approved as read the minutes of its regular <br /> <br />meeting held August 9, 1960 and of its special meeting held August 10, 1960. <br /> <br />Pursuant to duly-advertised public notice, Council conducted a duly-constituted <br /> <br />public hearing on the Andes-Weaver-Shelton petition--recently anproved by the <br /> <br />Planning Commission--requesting the rezoning from "A-1 Residential" to "B-1 <br /> <br />Business" of the Andes-Weaver property located on Oakdale Street and occupied <br /> <br />by Shelton Pharmacy. Council received no objections to the proposed or <br /> <br />requested rezoning and, subject to the inclusion of the Planning Co~mission's <br /> <br />recommended restrictions on the use of the property, adopted the following ordinance <br /> <br />amending the Cityls Zoning Code and Map, including the Commissionls recommended <br /> <br />restrictions as presented by City Manager Hirst, to which restrictions the <br /> <br />,.,,,,-....., <br /> <br />petitioners expressed agreement and understanding: <br /> <br />BE IT ORDAINED by the Council of the City of ~~rtinsville, Virginia, <br />in regular meeting assembled this twenty-third day of August, 1960, <br />that the City's Zoning Code and Zoning Map be and is hereby amended <br />to provide that the property located at 100 Oikdale Street, in <br />Martinsville, Virginia, owned by Mrs. Mattie B. Andes and Mrs. Lucille <br />Andes Weaver, and presently occupied by Shelton's Pharmacy, is hpreby <br />rezon€id from IfIA-1 Residential" to "B-1 Business" subject to the <br />following restrictions and conditions: <br /> <br />1. That the use of said property be limited to: <br />(a) Medical ard dental offices, and <br />(b) Apothecary shops, with the intent and understanding <br />that apothecary Shops shall be operated as a retail <br />business within a building the primary use of which <br />shall be a hospital, clinic, or physician's office, <br />providen that such apothecary shops shall sell only <br />drugs, prescription medicines (both ethical and <br />proprietary), medicinal supnlies and appliances, <br /> <br />9€ <br />
