<br />20: <br /> <br />MONDAY <br /> <br />AUGUS~ 29, 1960 <br /> <br />A special and duly-called meeting of the Council of the City of Martinsville, <br /> <br />Virginia, with Mayor John W. Shultz presiding, was held in the Council Chamber, <br /> <br />City Hall, Monday, August 29, 1960, at 1:15 P.M., for the purpose of considering <br /> <br />and/or acting upon the proposal presented to Council during its regular meetil11: <br /> <br />held August 23, 1960, by Mr. J. Ben Davis and associates, through their counsel, <br /> <br />Attorney A. L. Philpott. All members of Council were present, viz., Mayor John <br /> <br />w. Shultz, Vice-Mayor E. E. Stone, Thomas J. Burch, Clareme C. Donavant, am <br /> <br />-, <br /> <br />J. Frank Wilson. Also present were N.r. William B. Davis and counsel, Attorney <br /> <br />A. L. Philpott, as well as City Attorney Taylor, several City department heads, <br /> <br />am members of the local news services. <br /> <br />After the invocation, Council unanimously declared the meeting an official one, <br /> <br />pursuant to applicable provia ions of Section 5 of the City Charter. Counsel for <br /> <br />the petitioner, Attorney A. L. Philpott, at Council'S request, reviewed the <br /> <br />proposal presented to Coumil on August 23rd, i.e., in exchange for permission <br /> <br /> <br />to connect the Davis development to the City's sewerage system, the petitiorr"'!would <br />t\ <br /> <br />donate required right-of-way along its property near Smith River for the City's <br /> <br />sewerage system improvements program, would pay the required sewer connection fee, <br /> <br />.-' <br /> <br />and would pay the standard sewer service charges based on water used at the <br /> <br />developn:ent from their private source of supply. After some discussion, and upon <br /> <br />motion which was duly seconded and unanimously carried, Council offered the <br /> <br />followi~ proposition, subject to its inclusion in a contract to be prepared within <br /> <br />the framework of the City's policy governing water and sewer extensions outside the <br /> <br />City's corporate limits: <br /> <br />- <br /> <br />That, in exchange for all necessary easen:ents or right-of-way required <br /> <br />by the City from Mr. J. Ben Davis, his associates, and his heirs am <br />assigns, for water am/or sewer lines to be constructed by the City along <br />
