<br />~ '- ) \ .' <br />. _'.. n <br /> <br />TUESDAY <br /> <br />OCTOBER 24, 1967 <br /> <br />The regular semi-monthly meeting of the Council of the City of Martinsville, <br /> <br />Virginia, with Y.iB.yor F. T. Renick, M.D., presiding, was held Tuesday, October <br /> <br />24, 1967, in the Council Chamber, City Hall, beginning at 7:30 P.M., all members <br /> <br />being present, viz., Mayor F. T. R.enick, H.D.; Vice-Mayor E. E. Stone; Harry L. <br /> <br />Boaz; W. Donald Hartford; and Francis T. West. <br /> <br />After the invocation, Council approved as recorded the miuntes of its regular <br /> <br />meeting held October 10, 1967. <br /> <br />Upon motion, duly seconded and unanimously carried, Council accepted the <br /> <br />following report of the Planning Commission concerning the petition--submitted <br /> <br />recently by Messrs. L. R. Wyatt, Sr., and J. E. R.ichardson--requesting the closing <br /> <br />of an unopened portion of Burl street, thus denying said petition at this time for the <br /> <br />reasons and coned tions set forth in the Commiss ion 1 s report: <br /> <br />The Martine,ville City Planning Commission, at its meeting on Thursday, <br />October 19, 1967, gave further consideration to the petition referred <br />by Council requesting that a section of Burl Street to the rear and <br />adjacent to the Wyatt Buick Company property be closed and abandoned. <br /> <br />In its investigation of this petition the Commission learned that <br />there are four lots fronting on the north side of Burl Street in the <br />area which is requested to be abandoned. Should this portion of Burl <br />Street be abandoned these four lots would be left without street <br />frontage or means of access except across other lots. The Commission <br />was advised, however, that one of the four lots is owned by a person <br />who owns other property fronting Fayette Street that backs up to this <br />lot; also, that two of the remaining three lots are owned by other <br />persons al:::o owning adjacent lots fronting Fayette Street. The title <br />to the fourth lot is not clear at this time and no taxes have been <br />paid on the property in twelve years; however, this lot would be left <br />with no frontage and no means of access. The Commission was also <br />advised by the Attorney for the petitioner that all of the available <br />property owners had been contacted with the exception of the last lot <br />in question and that those contacted had no objection to the closing <br />and abandonment of Burl Street as requested. <br /> <br />Following due consideration of these facts, the Commission, with five <br />of its members present, voted unanimously to make the following <br />recommendation to Council: That Council deny the closing of this <br />street at this time and until a certified survey of all of the property <br />involved be made to determine ownership of all properties fronting <br />Burl Street. <br />
