<br />il-! <br /> <br />TUESDAY <br /> <br />JUNE 6, 1972 <br /> <br />A special and duly-called meeting of the Council of the City of Martinsville, <br /> <br />Virginia, was held Tuesday, June 6, 1972, in the Council Chamber, City Hall, <br /> <br />beginning at 12:15 P.M., for the purpose of discussing the employment of <br /> <br />additional counsel to assist the City Attorney in handling the matter of <br /> <br />Fralin & Waldron, Inc., vs. City of Martinsville, now pending in Federal <br /> <br />Court. With the exception of Councilman W. Donald Hartford, absent because <br /> <br />of illness, all members of Council were present, viz., Mayor F. T. Renick, M.D.; <br /> <br />Francis T. West, Vice Mayor; Harry L. Boaz; and William D. Hobson. <br /> <br />Following a reading of the statement of the purpose of this meeting, Vice-Mayor <br />of <br />West reviewed the sequence of events which led to the calling/this meeting, <br /> <br />beginning with approximately May 22nd or May 23rd (1972) and after there was <br /> <br />public knowledge that a suit was being filed in Federal Court by Fralin & <br /> <br />Waldron, Inc., against Martinsville City Council and Martinsville Planning <br /> <br />Commission to compel the issuance of a Special-Use Permit or some such similar <br /> <br />authorization to plaintiff, previously denied, beginning with Vice-Mayor West's <br /> <br />inquiry of State Senator William F. Stone as to whether Senator Stone's law <br /> <br />firm would be available (if requested) to assist in defending the City of <br /> <br />Martinsville in said suit, on the assumption--as in a prior Federal Court <br /> <br />suit in which the City was defendant--that the City of Martinsville would <br /> <br />desire additional legal assistance, i.e., to assist the City Attorney; then, <br /> <br />through a period of time during which Vice-Mayor West--by verbal contacts and <br /> <br />letters--urged the selecting of a local law firm for this purpose, or postponing <br /> <br />the selecting of any law firm pending further consultation by members of City <br /> <br />Council. With specific reference to the local law firm of Stone, Joyce, Worth & <br /> <br />Stone, Vice-Mayor West pointed out that both Senator Stone and his former partner, <br /> <br />Mr. Hannibal Joyce, for a period of many years served the City as City Attorney(s), <br /> <br />that this firm enjoys prestige and a wide reputation, and--as in the case of other <br /> <br />l . <br />
