<br />A special and duly-called meeting of the Council of the City of Martinsville, Virginia,
<br />
<br />with Mayor William C. Cole, Jr., presiding, was held Monday, October 15, 1984, in the
<br />
<br />Council Chamber, City Hall, beginning at 5:00 P.M., for the purpose of considering and/
<br />
<br />or adopting an ordinance to rescind an ordinance adopted by Council on August 28, 1984,
<br />
<br />which August 28th ordinance requested a bond referendum and/or election on the issuance
<br />
<br />of up to $3,325,000 general obligation bonds to finance a proposed sewage treatment
<br />
<br />plant expansion and various sewer system improvements. All members of Council were pre-
<br />
<br />,-,

<br />sent, viz., William C. Cole, Jr., Mayor; Eliza H. Severt, Vice-Mayor; Alfred T. Groden;
<br />
<br />L. D. Oakes; and Clyde L. Williams.
<br />
<br />After the invocation, the purpose of this special meeting was stated, followed by explan-
<br />
<br />atory comments--as to the legal processes and option involved--by City Manager Edmonds
<br />
<br />and City Attorney Worthy; whereupon motion by Vice-Mayor Severt, seconded by Councilman
<br />
<br />Williams, to adopt an ordinance rescinding the adopted August 28th ordinance (as to the
<br />
<br />proposed sewer bond referendum), Council unanimously adopted such a rescinding ordinance,
<br />
<br />with "emergency clause" attached (making same effective immediately), as follows:

<br />AN ORDINANCE RESCINDING AN ORDINANCE ADOPTED ON AUGUST 28, 1984,
<br />REQUESTING A BOND REFERENDUM ON THE ISSUANCE OF UP TO $3,325,000
<br />GENERAL OBLIGATION BONDS TO FINANCE SEWER PLANT EXPANSION AND
<br />VARIOUS SEWER SYSTEM IMPROVEMENTS
<br />
<br />WHEREAS, the City Council of the City of Martinsville, Virginia, (the
<br />"City") adopted an ordinance on August 28, 1984, (the "Election
<br />Ordinance") requesting the Circuit Court of the City of Martinsville
<br />to order a special election on the question of the issuance of the
<br />City's general obligation bonds in an amount not to exceed $3,325,000
<br />(the "Sewer Bonds") to finance a sewer plant expansion and various
<br />sewer system impFovements; and
<br />
<br />WHEREAS, the Circuit Court of the City of Martinsville has entered
<br />an order (the "Election Order") directing the Electoral Board of the
<br />City to conduct a special election on November 6, 1984, on the
<br />question of the issuance of the Sewer Bonds; and
<br />
<br />WHEREAS, the City Council has determined that it is in the best
<br />interest of the City to rescind the Election Ordinance and to
<br />request the Circuit Court of the City of Martinsville to vacate the
<br />Election Order; now, therefore,
