Enclosure #2 <br /> <br />CITY OF MARTINSVILLE, VIRGINIA <br />ORDINANCE NO. 2000-7 <br /> <br />BE IT ORDAINED by the Council of the City of Martinsville, Virginia, in regular session assembled on <br />October ,2000, that it does hereby amend Chapter 21--Taxation, Article III--Tax on Purchasers of <br />Utility Services of the City Code, as follows: <br /> <br />ARTICLE III. TAX ON PURCHASERS OF UTILITY SERVICES <br /> <br />Sec.21-28. Definitions <br /> <br />For the purposes of this article, the following words and terms shall have the meanings respectively <br />ascribed to them by this session: <br /> <br /> Consumer. The term "consumer" means every person who, individually or through agents, <br />employees, officers, representatives or permitees. makes a taxable purchase of electricity in this <br />jurisdiction. <br /> <br /> Commercial or industrial consumer. The term "commercial or industrial user" shall mean the <br />owner or tenant of property used for commercial, industrial and all other purposes, except private <br />residential property, who pays for utility services for said property. <br /> <br /> Purchaser. The word "purchaser" means every purchaser or user of electric service or water <br />service, unless otherwise specifically exempted by the city. <br /> <br /> Kilowatt hours (kit/h) delivered. The term (kilowatt hours (kWh) delivered means 1000 watts of <br />electricity delivered in a one-hour period by an electric provider to a consumer, except that in the case of <br />eligible customer-generators (sometimes called cogenerators) as defined in Virginia Code 56-594. it means <br />kWh supplied from the electric grid to such customer-generators, minus the kWh generated and fed back to <br />the electric grid by such customer generators. <br /> <br />Person. The term "person" means any individual. corporation. company or other entity. <br /> <br /> Residential ;;so;' consumer. Thc term "residential nscr" shall mcan thc owner or tenant of privatc <br />residential property who pays for utihty service in or for such property. The term" residential consumer' <br />means the owner or tenant of property used primarily for residential purposes, including but not limited to. <br />single-family dwellings, apartment houses and other multiple-family dwellings. <br /> <br /> Serviceprovider. The term "service provider" means the person or business to include the City of <br />Martinsvflle. who delivers electricity or water service, whether metered or uumetered. <br /> <br /> Used primarily. The term "used primarily" relates to the larger portion of the use for which <br />electric utility service is furnished. <br /> <br /> Seller. The word "seller" mcarm any pcrson who sells and furnishes any utility scrvicc, whether <br />metered or uumctcrcd. <br /> <br /> Utility service. The term '"utility service" means electric service or water service fumished or used <br />within the corporate limits of the city. <br />(Code 1971, 6-38) <br /> <br /> <br />
