<br />APPENDIX A-SUBDIVISION ORDINANCE <br /> <br />4-3 <br /> <br />3-5. Deferred installation of public improvements. <br /> <br />After a plat has been recorded, certain public improvements not otherwise identified for <br />deferral per subsection 5-5-1 of this ordinance may be considered for installation at a point <br />subsequent to the issuance of a certificate of occupancy. Such approval shall only be granted <br />after consultation with the respective departments or agencies charged with operation, <br />acceptance and maintenance of said improvements. Prior to approval, the administrator shall <br />require a fifty ($50.00) dollar fee and a written request from the subdivider or developer which <br />shall identify the justification for the deferral and a committed date for completion of the <br />improvement beyond which subdivision re-approval shall be required for additional deferral. <br />In no case shall any improvement be deferred beyond two (2) years following the issuance of <br />the first building permit for any lot in the subdivision. <br /> <br />SECTION 4. PROCEDURE FOR MAKING AND RECORDING PLATS <br /> <br />4-1. Platting required. <br /> <br />Any owner or developer of any tract ofland situated within the corporate limits of the City <br />of Martinsville who subdivides the same shall have recorded in the office of the clerk of the <br />circuit court a plat of the subdivision. No such plat or any subdivision shall be recorded until <br />it shall have been approved in accordance with the regulations set forth in this ordinance. No <br />lot shall be sold in any such subdivision before the plat shall have been recorded. <br /> <br />4-2. Draw and certify. <br /> <br />Every such plat shall be prepared by a surveyor duly licensed by the State of Virginia, who <br />shall endorse upon each plat a certificate signed by him setting forth the source of the title of <br />the land subdivided, and the place of record of the last acquired from more than one source <br />title. When the plat is of land acquired from more than one source of title, the outlines of the <br />several tracts shall be indicated upon such plat by an insert block, or by means of a dotted <br />boundary line upon the plat. <br /> <br />4-3. Owners statement. <br /> <br />Every such plat, or the deed of dedication to which such plat is attached, shall contain in <br />addition to the surveyor's or engineer's certificate a statement to the effect that "the above and <br />foregoing subdivision of (here insert correct description of the land subdivided), as appears in <br />this plat, is with the free consent and in accordance with the desire of the undersigned owners, <br />proprietors, and trustees. The acknowledgements of deeds shall be executed and approved as <br />herein specified, and shall be filed and recorded in the office of the clerk of the circuit court of <br />the City ofMartinsville, Virginia and indexed under the names of the land owners signing such <br />statement and under the name of the subdivision. <br /> <br />Supp. No. 61 <br /> <br />1733 <br />
