Chapter 16 <br /> <br />RIOTS AND UNLAWFUL ASSEMBLIES* <br /> <br />Sec. 16-1. <br />Sec. 16-2. <br />Sec. 16-3. <br />Sec. 16-4. <br />Sec. 16-5. <br /> <br />What constitutes. <br />Participation in. <br />Remaining at scene after warning to disperse. <br />Method of dispersal. <br />Immunity of dispersing officers. <br /> <br />Sec. 16-1. What constitutes. <br /> <br /> (a) For the purposes of this chapter, any unlawful use, by three (3) or more persons ac~ing <br />together, of force or violence which seriously jeopardizes the public safety, peace or order is a <br />riot. <br /> <br /> (b) For the purposes of this chapter, whenever three (3) or more persons assembled share <br />the common intent to advance some lawful or unlawful purpose by the commission of an act or <br />acts of unlawful force or violence likely to seriously jeopardize public safety, peace or order, <br />and the assembly actually tends to inspire persons of ordinary courage with well-grounded <br />fear of serious and immediate breaches of public safety, peace or order, such assembly is an <br />unlawful assembly. <br /> State law reference--Similar provisions, Code of Virginia, §§ 18.2-405, 18.2-406. <br /> <br />Sec. 16-2. Participation in. <br /> <br /> (a) It shall be unlawful and a Class 1 misdemeanor for any person to participate in any <br />riot or unlawful assembly within the city. <br /> <br /> (b) This section shall not apply to a person who, at the time of his participation in a riot or <br />unlawful assembly, carried any firearm or other deadly or dangerous weapon. Cross reference--Penalty for Class I misdemeanor, § 1-11. <br /> State law reference--Similar provisions, Code of Virginia, § § 18.2-405, 18.2-406, which <br />make the offense, under circumstances stated in subsection (b) above, a felony. <br /> <br />Sec. 16-3. Rem_~iniug at scene after warning to disperse. <br /> <br /> Every person, except the owner or lessee of the premises, his family and nonrioting <br />guests, and public officers and persons assisting them, who remains at the place of any riot or <br />unlawful assembly, after having been lawfully warned to disperse, shall be guilty of a Class 3 <br />misdemeanor. <br /> Cross reference--Penalty for Class 3 misdemeanor, § 1-11. <br /> State law reference--Similar provisions, Code of Virginia, § 18.2-407. <br /> <br />*Cross reference--Parades, assemblies or demonstrations on city property, § 2-2. <br /> <br />961 <br /> <br /> <br />
