FIRE PREVENTION AND PROTECTION § 9-64 <br /> <br /> (c) The provisions of this section shall not apply to outdoor cooking with charcoal, pro- <br />vided such charcoal is fully contained within a grill or fireplace of metal, brick, stone or other <br />noncombustible material and such grill or fireplace is at least three (3) feet from any <br />combustible material. <br /> (d) Any open burning not allowed by this section may be done by special permission of the <br />fire chief and only in accordance with applicable rules and regulations adopted by the state air <br />pollution control board, pursuant to sections 10-17.10 through 10-17.30 of the Code of Virginia <br />(1950). <br />(Ord. of 8-24-82, § 8-7; Ord. of 5-10-83, § 8-7) <br /> <br />Sec. 9-62. Prohibited during certain times. <br /> It shall be unlawful for any person to burn any leaves, paper, trash or other material <br />outdoors during the duration of an alert, warning or emergency stage in what is known as an <br />"air pollution episode," when so proclaimed by the executive director of the state air pollution <br />control board or his designated representative, or during periods of extreme drought condi- <br />tions which cause forests, brush or grass to become so dry or parched as to create an extraor- <br />dinary fire hazard, when so proclaimed by the city fire chief or city manager. <br />(Ord. of 8-24-82, § 8-6; Ord. of 5-10-83, § 8-6) <br /> <br />Sec. 9-63. Prohibited on street or sidewalk. <br /> It shall be unlawful for any person to burn any leaves, paper, trash or other material in or <br />on any public street or sidewalk in the city. <br />(Ord. of 8-24-82, § 8-4; Ord. of 5-10-83, § 8-4) <br /> Cross reference--Streets and sidewalks, Ch. 19. <br /> <br />Sec. 9-64.
