§ 8-22 <br /> <br />MARTINSVILLE CODE <br /> <br /> (c) Where land-disturbing activities involve lands under the jurisdiction of the city and <br /> Henry County, a plan shall be submitted to both jurisdictions for review and approval or may <br /> be submitted to the board for approval. <br /> <br /> (d) In order to prevent further erosion, the building official may require submission and <br /> approval of a conservation plan for any land identified as an erosion impact area. <br /> (Ord. of 2-23-82, §§ 3.2-3.4; Ord. No. 90-15, 11-27-90) <br /> State law reference--Control plan required, Code of Virginia, § 21-89.6. <br /> <br /> Sec. 8-23. Review and approval or disapproval. <br /> <br /> (a) The building official shall have the responsibility of reviewing and approving erosion <br />and sediment control plans submitted under this article. During his review of any plan, he <br />shall consult with the city engineer and other personnel or the Virginia Polytechnic Institute <br />Extension Service for technical advice and assistance. <br /> <br /> (b) In determining the adequacy of a plan, the building official shall be guided by the <br /> requirements, standards and recommendations contained in this chapter and the 1980 Edition <br /> of the Virginia Erosion and Sediment Control Handbook, as amended. <br /> <br /> (c) A plan shall be approved, within forty-five (45) days from receipt thereof by the building <br /> official, if the plan meets the requirements of the board's regulations. <br /> <br /> (d) If a plan is disapproved, within forty-five (45) days from the receipt thereof, the building <br />official shalj specify, in writing, such modifications, terms and conditions as will permit ap- <br />proval of the plan and communicate these requirements to the applicant. <br /> <br /> (e) If no action is taken by the building official within forty-five (45) days of the receipt of <br />a plan, the plan shall be deemed approved and a land-disturbing permit shall be issued under <br />article III of this chapter. <br />(Ord. of 2-23-82, § 3.3; Ord. Changing approved plan. <br /> <br /> An approved plan may be changed: <br /> <br /> (1) Where inspection has revealed the inadequacy of the plan to accomplish the erosion <br /> and sediment control objectives of the plan; or <br /> <br /> (2) When the person responsible for carrying out the approved plan finds that, because of <br /> changed circumstances or for other reasons, the approved plan cannot be effectively <br /> carried out, and proposed amendments to the plan, consistent with the requirements <br /> of the regulations, are agreed upon by the building official and the person responsible <br /> for carrying out the plan. <br />No changes in time sequence greater than one year shall be granted. Postponement of any <br />work included in an approved plan for longer than one year shall require the applicant to <br />receive a new permit for this work. <br />(Ord. of 2-23-82, § 3.5; Ord.
