§ 8-1 MARTINSVILLE CODE <br /> <br /> Permittee: The person to whom the permit authorizing land-disturbing activities is issued <br />or the person who certifies that the approved erosion and sediment control plan will be fol- <br />lowed. <br /> <br /> Person: Any individual, partnership, firm, association, joint venture, public or private <br />corporation, trust, estate, commission, board, public or private institution, utility, cooperative, <br />county, city, town or other political subdivision of this state, any interstate body or any other <br />legal entity. <br /> <br /> Plan-approving authority: The building official, who is responsible for determining the <br />adequacy of a conservation plan submitted for land-disturbing activities on a unit or units of <br />lands. <br /> <br /> State erosion and sediment control program or state program: The program adopted by the <br />board consisting of conservation regulations to minimize erosion and sedimentation. <br /> <br /> State waters: All waters on the surface and under the ground wholly or partially within or <br />bordering the commonwealth or within its jurisdiction. <br /> <br /> Subdivision: The division of a parcel of land into two (2) or more lots or parcels for the <br />purpose of transfer of ownership or building development or, if a new street is involved, any <br />division of a parcel of land; provided that a division of land for agricultural purposes into lots <br />of five (5) acres or more and not involving a new street shall not be deemed a subdivision. The <br />term includes resubdivision and, when appropriate to the context, shall relate to the process <br />of subdividing or to the land subdivided. <br /> <br /> Transporting: Any moving of earth materials from one place to another, other than such <br />movement incidental to grading, when such movement results in destroying the vegetative <br />ground cover, either by tracking or buildup of earth materials, to the extent that erosion and <br />· sedimentation will result from the soil or earth materials over which such transporting <br />occurs. <br />(Ora. of 2-23-82, § 2.1; Ord. Purpose of chapter. <br /> <br /> The purpose of this chapter is to conserve the land, water, air and other natural resources <br />of the city and promote the public health and welfare of the people in the city by establishing <br />requirements for the control of erosion and sedimentation and by establishing procedures <br />whereby these requirements shall be administered and enforced. <br />(Ord. of 2-23-82, § 1.1) <br /> <br /> Sec. 8-3.
