ANIMALS AND FOWL § 5-40 <br /> <br /> (i) The owner of any animal which has been found by a court to be a dangerous dog who <br />willfully fails to comply with the requirements of the ordinance shall be guilty of a Class 1 <br />misdemeanor. <br /> <br /> (j) All fees collected pursuant to this chapter, less the costs incurred by the animal control <br />officer in producing and distributing the certificates and tags required by the ordinance, shall <br />· be paid into a special dedicated fund in the treasury of the locality for the purpose of paying <br />the expenses of any training course required under Code of Virginia § 3.1-796.105. <br />(Ord. Noisy dog. <br /> <br /> No person shall have or keep within the city any dog or dogs which, by mal~ing or causing <br />frequent or long continued and unreasonable noise, shall disturb the peace and quiet of any <br />person or neighborhood. Upon complaint being made to any animal control officer, deputy <br />animal control officer or police officer, after investigation, the animal control officer or officer <br />may give notice of such complaint to the owner or person in charge of such dog or dogs and <br />order the discontinuance of the disturbance. Any person failing to comply with such order shall <br />be guilty of a Class 4 misdemeanor. <br />(Ord. Vaccination against rabies of dogs and domesticated cats; proof of cat <br /> ownership. <br /> <br /> (a) The owner or custodian of all dogs and domesticated cats four (4) months of age and <br />older shall have them currently vaccinated for rabies by a licensed veterinarian, who shall <br />provide the owner of the dog or the custodian of the domesticated cat with a certificate of <br />vaccination and a rabies tag. The owner of the dog or the custodian of the domesticated cat <br />shall furnish within a reasonable period of time, upon the request of an animal ~control officer, <br />humane investigator~ law-enforcement officer, or official of the Department of Health, the <br />certificate of vaccination for such dog or cat. The vaccine used shall be licensed by the United <br />States Department of Agriculture for use in that species. <br /> <br /> (b) All domestic cats four (4) months of age and older are required to wear a collar bearing <br />proof of current rabies vaccination which shall serve as proof of ownership. Any cat not <br />wearing a collar bearing proof of rabies vaccination is deemed to be feral and, upon a citizen's <br />request, may be humanely trapped at the citizen's residence or place of business. The citizen <br />m~king the request may claim ownership based upon the definition of ownership contained in <br />the Code of Virginia, § 3.1-796.66. Otherwise, the citizen/owner shall fill out a form releasing <br /> <br />Supp. No. 42 325 <br /> <br /> <br />
