ANIMALS AND FOWL <br /> <br />§ 5-47 <br /> <br />Sec. 5-44. Confinement of a female dog in heat. <br /> <br /> Every female dog in heat shall be confined in a building or secure enclosure in such a <br />m~nner that such female dog cannot come into contact with another animal except for planned <br />breeding. <br />(Ord. No. 95-9, 9-26-95) <br /> State law reference-Virginia Code, § 3.1-796.128. <br /> <br />Sec. 5-45. Quarantine during rabies epizootic. <br /> <br /> When an emergency exists in the city or any section thereof, due to a widespread rabies <br />epizootic, or when there are vicious or destructive dogs and/or cats running at large, for the <br />protection of the public health, the city council may adopt an ordinance declaring a quarantine <br />in the city or such section thereof as may be affected, and restrict all dogs and/or cats to the <br />owner's premises or to the immediate custody of a responsible person for the duration of such <br />emergency. Any dog and/or cat owner or custodian who violates this chapter shall be guilty of <br />a Class 1 misdemeanor. <br />(Ord. Reporting rabid animal; concealing or harboring rabid animal. <br /> <br /> (a) Every person having knowledge of the existence of an animal apparently affected with <br />rabies shall report immediately to the health department the existence of such ~nlmal, the <br />place where seen, the owner's name, if known, and the symptoms suggesting rabies. <br /> <br /> (b) It shall be unlawful for any person to conceal or harbor in the city any rabid animal. <br />(Ord. City dog pound; confinement and disposition of animals. <br /> <br /> (a) Any dog found running at large without the license tag required by section 5-55' or <br />otherwise in violation of this chapter, shall be impounded by the animal control officer or other <br />officer at the city dog pound. <br /> <br /> (b) A dog confined pursuant to subsection (a) shall be kept for a period of not less than five <br />(5) days, such period to commence on the day immediately following the day the dog is initially <br />confined in the facility, unless sooner claimed by its owner thereof, or, if the dog's rightful <br />owner has surrendered all property rights in such dog and has read and signed a statement as <br />required by subsection (g), disposed of as provided in subdivisions (e)(2),(3), (4), and (5). <br /> <br /> (c) Any feral dog not bearing a collar, tag, tattoo or other form of identification which, <br />based on the written certification of a disinterested person, exhibits behavior that poses a risk <br />of physical injury to any person confining the dog, may be euthanized after being kept for a <br />period of not less than three (3) days, at least one of which shall be a full business day, such <br />period to commence on the day the dog is initially confined in the facility, unless sooner claimed <br /> <br />Supp. No. 36 327 <br /> <br /> <br />
