_ f..---~ CHARTER Ch. 14, § I <br /> <br />corporate surety, as may be required by general law, by this Charter or by ordinance or <br />resolution of the council, and file the same with the circuit court clerk before entering upon <br />the discharge of their duties. The city shall pay the premiums on such bonds. <br /> <br />Sec. 5. Investigations. <br /> <br /> The council, the city manager, and any officer, board or Commission authorized by them <br />or either of them, shall have power to make investigation as to city affairs, and for the purpose <br />to subpoena witnesses, administer oaths, and compel the production of books and papers. <br /> <br /> Any person refusing or failing to attend, or to testify or to produce such books and papers, <br />may by summons issued by such board or officer by [be] summoned before the general district <br />court of the said city' by the board or official making such investigation, and upon failure to <br />give satisfactory explanation of such failure of [or] refusal, may be fined by the general district <br />court not exceeding one hundred dollars or imprisonment [imprisoned] not exceeding thirty <br />(30) days, and such person shall have the right to appeal to the Circuit Court of the City of <br />Martinsville. Any person who shall give false testimony under oath at any such investigation <br />shall be liable to prosecution for perjury. <br />(Acts 1982, Ch. 193, § 1) <br /> <br />Sec. 6. Working prisoners. <br /> <br /> Subject to the general laws of the state regulating the working of those convicted of <br />offenses against the state, the council shall have the power to provide by ordinance for the <br />employment or the working of prisoners, either within or without the city limits, or within or <br />without any city prison or jail, for the violation of the laws of the State of Virginia, or the <br />or{iinances of the City of Martinsville. <br /> <br />Sec. 7. Penalty for officers failing to perform duties. <br /> <br /> If any officer of the City of Martinsville, whether he be elected by vote of the people or by <br />the council, or appointed by the council, or the city manager, shall fail or refuse to perform <br />any of the duties required of him by this chapter or by ordinance or resolution of the city <br />council, he shall be subject to a fine of not less than five dollars nor more than one hundred <br />dollars for each offense, and he and his sureties on his official bond shall be liable for all <br />damages which may accrue to the city or any other person by reason of such failure or refusal. <br /> <br /> CHAPTER 14. MISCELLANEOUS <br /> <br />Sec. 1. Adoption of ordinances in conflict with ABC Act. <br /> <br /> Nothing in this act [Charter] shall authorize the adoption of any ordinance in conflict <br />with any of the provisions of the Virginia Alcoholic Beverage Control Act. <br /> <br />29 <br /> <br /> <br />
