Ch. 1, § 2 MARTINSVILLE CODE <br /> <br />Should the council determine to act as the.commissioners of the Martinsv~le Redevelop- <br /> merit and Housing Authority as above provided, it shall 'designate which of the <br /> commissioners shall be the chairman of the authority, and four commissioners shall <br /> constitute a quorum of the said authority for the purpose of conducting its business <br /> and exercising its powers and for all purposes, and action may be taken by the <br /> authority upon the vote of a majority of the commissioners present, unless in any case <br /> the bylaws of the authority shall require a larger number. <br /> <br /> The determination of the council made hereunder and any determination that may be <br /> made by the authority as constituted hereunder shall be effective without the <br /> prerequ/site of an election being held to determine the question as provided by the <br /> Housing Authorities Law. Nothing herein contained shall be construed to prevent the <br /> council and the authority from otherwise proceeding under and in accordance with <br /> the Housing Authorities Law; provided, however, that notwithstanding any other <br /> provision of T/fie 36 of the Code of Virginia, no bonds of the authority shall be issued <br /> unless and until a majority of the voters voting on the question of such bond issued <br /> shall have approved the same in a referendum called and held in accordance with § <br /> 4118 2 of chapter 11] of this Charter. <br />(Acts 1956, Ch~ 586; Acts 1962, Ch. 329; Acts 1975, Ch. 416; Acts 1982, Ch. 193, § 1; Acts 1991, <br />Ch. 15, § 1; Acts 1995, Ch. 172, § 1) <br /> <br />Sec. <br /> <br /> CHAPTER 2. THE COUNCIL <br />1. Created; general powers. <br /> <br /> There shall be a council which shall have full power and authority, except as herein <br />otherwise provided, to exercise all the powers conferred upon the city, and to pass all laws and <br />ordinances relating to its municipal affairs, subject to the Constitution and general laws of the <br />state and of this Charter. <br /> <br />Sec. 2. Composition; election and terms of members; to be continuing body; ~Hing <br /> of vacancies; removal of member for absenteeism. <br /> <br /> The council shall be elected as provided by general law. The council shall consist of five <br />members, who shall be elected at large and serve for aterm of four years from the first day of <br />July next following the date of their election and until their successors have been elected and <br />qualified. <br /> <br /> The terms of councilmen shall be staggered. Two councilmen shall be elected in the year <br />in which their predecessors' terms in office expire and three councilmen shall be elected in the <br />year in which their predecessors~ terms in office expire.
