<br /> THIS AGREEMENT, made in duplicate this , day of
<br /> · 1999, by and between Gregory D. Craven, and Shirley A. Craven,,
<br />party of the first part, hereinafter referred to as the Developer, and the City of
<br />Martinsville, Virginia, a Municipal corporation, party of the second part, hereinafter
<br />referred to as the City.
<br />
<br />WITNESSETH:
<br />
<br /> THAT WHEREAS, the developer owns a certain tract of land called Pebble
<br />Creek Subdivision, located on the eastern end of Blankenship Road, off of Chatham
<br />Road in the City of Martinsville, Virginia; and,
<br />
<br /> WHEREAS, the Developer is desirous of subdividing said tract of land,
<br />hereinafter referred to as Subdivision, into residential lots in the manner as shown on a
<br />proposed plan for subdividing said tract prepared by Piedmont Land Surveying, L.L.C.,
<br />October 8, 1999, and,
<br />
<br /> WHEREAS, the Developer submitted the above referred to plan to the City
<br />Planning Commission on October 14, 1999, and was given final approval by said agent of
<br />the Planning Commission on , and,
<br />
<br /> WHEREAS, the Developer and the City, for the mutual benefit of both
<br />parties have agreed to the following terms and conditions pertaining to street and utility
<br />improvements in the City of Martinsville, Virginia, along: Blankenship Road for a
<br />distance of approximately 430 feet; approximately 860 feet along Pebble Road, from cul
<br />- de - sac to cul - de - sac; approximately 475 feet along Stoney Court to the cul - de -
<br />sac, as shown on a plan dated October 8, 1999, pursuant to the Subdivision Ordinance of
<br />Martinsville, Virginia, adopted December 17, 1957, as amended;
<br />
<br /> NOW THEREFORE, the parties to this Agreement, in consideration of the
<br />mutual covenants herein contained, do hereby agree as follows:
<br />
<br />The Developer shall provide, at its sole expense· the following
<br />improvements to the hereinbefore designated streets:
<br />A. The Developer shall clear and grade the entire width of fight -
<br /> of- way, for a distance of approximately 430 feet along
<br />
