Enclosure #2 <br /> <br />CITY OF MARTINSVILLE, VIRGINIA <br /> <br />ORDINANCE NO. 99-9 <br /> <br />BE IT ORDAINED by the Council of the City of Martinsville, Virginia, in regular <br />session assembled on October __, 1999, that Chapter 13--Offenses-Miscellaneous, <br />Article I--In General, Section 13-15--Prohibited Trick or Treat Activities of the <br />Martinsville City Code be amended so that paragraph (b) thereunder shall read as <br />follows: <br /> <br />Sec. 13-15. Prohibited trick or treat activities. <br /> <br /> (a) If any person over the age of twelve (12) years shall engage in the activity <br />commonly known as "trick or treat" or any other activity of similar character or nature <br />under any name whatsoever, he shall be guilty of a Class 4 misdemeanor. Nothing herein <br />shall be construed as prohibiting any parent, guardian or other responsible person, having <br />lawfully in his custody a child twelve (12) years old or younger, from accompanying <br />such child who is playing "trick or treat," for the purpose of caring for, looking after or <br />protecting such child. <br /> <br /> (b) If any person shall engage in the activity commonly known as "trick or treat" <br />or any other activity of similar character or nature under any name whatsoever after I 9:99 <br />p.m. 9:00p. m. or on a day other than Halloween (except when Halloween falls on a <br />Sunday and City Council has by proclamation declared that Halloween shall be <br />celebrated on the preceding Saturday), he shall be guilty of a Class 4 misdemeanor. <br /> <br />Attest: <br /> <br />Johnathan B.
