such sales equal to not less than fifty percent (50%) of Net Operating Profit from <br />such sales, or the same amount and/or percentage of Net Operating Profit that Club <br />receives from its contractual arrangement with its sub-lessee or assignee for <br />concession sales during all regularly scheduled league games, all-star, playoff and <br />championship series games. Club shall provide a copy of its contract with any sub- <br />licensee or assignee for concession sales to City not later than June 1 of each year <br />of this Lease, prior to the beginning of each regular season of play. In addition, a <br />complete and accurate statement of Gross Receipts, Costs of Operation, and Net <br />Operating Profit figures on all concessions sales at any games, activities or events <br />other than regularly scheduled league games, all-star, playoff and championship <br />series games held at the Field shall be provided to the office of the City's Director of <br />Finance not later than October 1 of each year of this Lease. Payment of the City's <br />share of Net Operating Profits from such sales shall be provided to the City's <br />Director of Finance within two business days following any such game, activity or <br />event sales. <br /> <br />If Club or its sub-lessee or assignee does not intend to conduct sales of concession <br />merchandise or materials to the public at any regularly scheduled league game, all- <br />star, playoff or championship series game held at the Field, Club will notify City of <br />its intention at least seven (7) calendar days prior to the event. Upon receiving such <br />notice City may itself, at its option, furnish the concession services and retain for <br /> <br />itself all revenues derived thereby.
