TUESDAY, SEPTM~BER 26, 1989 <br /> <br />SECTION 11. PAYMENT TO MUNICIPALITY. <br /> <br /> As compensation for the privilege granted hereunder to the grantee <br />for the use of the streets of the city, the grantee shall pay to the city each <br />year in lieu of any other permit charge, but in addition to the other <br />obligations imposed under this franchise, an amount equal to Ten Thousand <br />Dollars ($10,000) in each of the first ten years of this franchise, Fifteen <br />Thousand Dollars ($15,000) in each of the eleventh to twentieth years (both <br />inclusive) of this franchise, and Twenty Thousand Dollars ($20,000) in each of <br />the twenty-first to the thirtieth years (both ihclusive) of this franchise. <br /> <br />SECTION 12. SAFETY METHODS AND EQUIPMENT. <br /> <br /> The grantee shall at all times employ a high standard of care and <br />shall install and maintain in use approved methods and devices for preventing <br />fires, explosions, and other failures or accidents which are likely to cause <br />damages, injuries or nuisances. All construction, operation, and maintenance <br />shall be performed in accordance with all applicable local, state, and federal <br />safety codes and other applicable regulations. <br /> <br />SECTION 13. PLAT OF GAS PIPES. <br /> <br /> The grantee shall maintain a complete and detailed map of its <br />distribution system in the office of the grantee (open to the inspection of the <br />city) showing its current distribution system and all subsequent additions <br />and/or deletions to such distribution system. <br /> <br />SECTION 14. LIABILITY. <br /> <br /> (a) Damage Claims. By accepting this Ordinance and franchise, the <br />grantee, its successors and assigns, hereby agree to indemnify and save <br />harmless the city as a municipal corporation, from all loss, cost and expense <br />to which the city may be subjected for any damage or destruction that may be <br />done to or suffered by anyone in person or property for which the city may be <br />held to be liable by reason of any negligence on the part of the grantee, its <br />agents, servants or employees, provided nothing herein shall be construed to <br />relieve the city of negligence on the part of its agents, servants or <br />employees. <br /> <br /> (b) Certificate of Insurance. The grantee shall furnish a <br />certificate of insurance issued by responsible insurance companies providing <br />protection against liability of the grantee and of the city for loss sustained <br />by any person, firm or corporation with a combined limit of not less than <br />$1,000,000 for any one accident for bodily injury and property damage. <br />However, the grantee shall use its best efforts to obtain not less than <br />$3,000,000 of such liability insurance. Such insurance shall be kept <br />continuously in force during the entire term of this franchise and a <br />certificate of such insurance shall at all times be <br /> <br /> <br />
