TUESDAY, SEPTM~BER 26, 1989 SECTION 11. PAYMENT TO MUNICIPALITY. As compensation for the privilege granted hereunder to the grantee for the use of the streets of the city, the grantee shall pay to the city each year in lieu of any other permit charge, but in addition to the other obligations imposed under this franchise, an amount equal to Ten Thousand Dollars ($10,000) in each of the first ten years of this franchise, Fifteen Thousand Dollars ($15,000) in each of the eleventh to twentieth years (both inclusive) of this franchise, and Twenty Thousand Dollars ($20,000) in each of the twenty-first to the thirtieth years (both ihclusive) of this franchise. SECTION 12. SAFETY METHODS AND EQUIPMENT. The grantee shall at all times employ a high standard of care and shall install and maintain in use approved methods and devices for preventing fires, explosions, and other failures or accidents which are likely to cause damages, injuries or nuisances. All construction, operation, and maintenance shall be performed in accordance with all applicable local, state, and federal safety codes and other applicable regulations. SECTION 13. PLAT OF GAS PIPES. The grantee shall maintain a complete and detailed map of its distribution system in the office of the grantee (open to the inspection of the city) showing its current distribution system and all subsequent additions and/or deletions to such distribution system. SECTION 14. LIABILITY. (a) Damage Claims. By accepting this Ordinance and franchise, the grantee, its successors and assigns, hereby agree to indemnify and save harmless the city as a municipal corporation, from all loss, cost and expense to which the city may be subjected for any damage or destruction that may be done to or suffered by anyone in person or property for which the city may be held to be liable by reason of any negligence on the part of the grantee, its agents, servants or employees, provided nothing herein shall be construed to relieve the city of negligence on the part of its agents, servants or employees. (b) Certificate of Insurance. The grantee shall furnish a certificate of insurance issued by responsible insurance companies providing protection against liability of the grantee and of the city for loss sustained by any person, firm or corporation with a combined limit of not less than $1,000,000 for any one accident for bodily injury and property damage. However, the grantee shall use its best efforts to obtain not less than $3,000,000 of such liability insurance.
