Local erosion and sediment Control .program or local control program: <br />An outline or explanationof ~the..zvarious.!elements or methods employed by <br />the City to regulate land'd~;~'~'Bing~/~ivities 'and thereby minimize <br />erosion and sedimentation 'in compliance with the State program and <br />including such items as this chapter, policies and guidelines, technical <br />materials, inspection, enforcement and evaluation. <br /> <br /> Owner: 'The owner or owners of the freehold of the premises or lesser <br />estate therein, a mortgagee or yendee in possession, assignee ~of rents, <br />receiver, executor, trustee, lessee or other person, firm or corPoration <br />in control of a property. <br /> <br /> Permittee: The person to whom the permit authorizing land-disturbing <br />activities is issued or the person who certifies that the approved erosion <br />and sediment control Plan will be followed. <br /> <br /> Person: Any individual, partnership, firm, association, Joint <br />venture, public or private corporation, trust, estate, commission, board, <br />public or private institution, utility, cooperative, county, city, town or <br />other political subdivision of this State, any interstate body, or any <br />other legal entity. <br /> <br /> Plan-approving authority: The Building Official, who is responsible <br />for determining the adequacy of a conservation plan submitted for <br />land-disturbing activities on a unit or units of lands. <br /> <br /> State erosion and sediment control program or state program: The <br />program adopted by the CommiGcion Board consisting of conservation <br />regulations standards, guidolinoc and critcria to minimize erosion and <br />sedimentation. <br /> <br /> State waters: All waters on the surface and under the ground wholly <br />or partially within or bordering the Commonwealth or within its <br />Jurisdiction. <br /> <br /> Subdivision: The division of a parcel of land into two (2) or more <br />lots or parcels for the purpose of transfer of ownership or building <br />development or, if a new street is involved, any division of a parcel of <br />land; provided that a division of land for agricultural purposes into lots <br />of five (5) acres or more and not involving a new street shall not be <br />deemed a subdivision. The term includes resubdivision and, when <br />appropriate to the context, shall relate to the Drocess of subdividing or <br />to the land subdivided. <br /> <br /> Transporting: Any moving of earth materials from one place to <br />another, other than such movement incidental to grading, when such <br />movement results in destroying the vegetative ground cover either by <br />tracking or buildup of earth materials to the extent that erosion and <br />sedimentatton will result from the soil or earth materials over which such <br />transporting occurs. <br />(Ord. of 2-23-82, s 2.1) <br /> State law reference--Similar definitions, Code of Virginia, s 21-89.3. <br /> <br />Sec. 8-2.
