ARTICLE I. IN GENERAL <br /> <br />Sac. 8-1. Definitions. <br /> <br /> As'used in this chapter, unless the context clearly indicates <br />!Otherwise, certain terms, titles and phrases shall be defined as follows: <br /> <br /> Applicant: An~ 'person submitting an erosion and sediment control plan <br />i~or approval or requesting the"tssuance of a permit, when required, <br />authorizing land-disturbing activities to commence. <br /> <br /> Board or Board of Appeals: The board of appeals for erosion and <br />sediment control established by Article IV of this chapter. <br /> <br /> Commitsion Board-or' Virginia Soil and Water Conservation Commission <br />'Board: The agency 'created in'Section 21 e 10.1-502 of the Code of <br />Virginia. <br /> <br /> Clearing: Any activity which removes the ground cover and/or topsoil. <br /> <br /> Conservation plan, erosion and sediment control plan or plan: A <br />document containing material for the conservation of soil and water <br />resources of a unit or group of units of land. It may include appropriate <br />maps, an appropriate soil and water plan, inventory and management <br />information with needed interpretations, and a record of decisions <br />contributing to conservation treatment. The plan shall contain all major <br />conservation decisions to assure that the entire unit or units of land <br />will be so treated to achieve the conservation objectives. <br /> <br /> Conservation standards: The criteria, guidelines, techniques, and <br />methods for the control of erosion and sedimentation. <br /> <br /> District, or soil and water conservation district: The Blue Ridge <br />Soil and Water Conservation District, which is a governmental subdivision <br />of the State and a public body corporate and politic organized in <br />accordance with the Soil Conservation Districts Law, Title ~-~ 10.1, <br />Chapter-l-~, (s 21-1 et seq.), CODE OF VIRGINIA. <br /> <br /> Erosion impact area: An area of land not associated with current <br />land-disturbing activity but subject to persistent soil erosion resulting <br />in the delivery of sediment onto neighboring DroDerties or into state <br />waters. This definition shall not apply to any lot or parcel of land of <br />one acre or less used for residential putDoses. <br /> <br /> Excavating: <br />materials. <br /> <br />Any digging, scooping or other method of removing earth <br /> <br />Filling: Any depositing or stockpiling of earth materials. <br /> <br /> Grading: Any excavating or filling of earth materials or any <br />combination thereof. <br /> <br /> Land-disturbing activity: Any land change which may result in soil <br />erosion from water or wind and the movement of sediments into waters or <br />onto lands, including, but not limited to, clearing, grading, excavating, <br /> <br /> <br />
