requirements of Section 1 of Chapter 5 of the City Charter <br />are met prior to any such removal, subject to the <br />provisions, if applicable', of paragraph 10 of the ordinance <br />described in Section 5 of this agreement. In the event that <br />Employee voluntarily resigns his position with Employer, <br />then Employee shall give Employer 60 days notice and shall <br />~=receive full salary and other benefits during said 60 days. <br /> <br /> 'If Employee is permanently disabled or is otherwise unable <br /> <br /> to perform his duties because of sickness, accident, injury, <br /> <br />!mental incapacity or health for a period of four successive <br /> weeks beyond any accrued sick leave, or for twenty working <br /> <br /> days over a thirty working day period, Employee shall have <br /> the option to terminate this agreement subject to the <br /> <br /> aforesaid Charter provisions and subject to the right of <br /> Employee to be compensated for any accrued sick leave, <br /> vacation, holidays, compensatory time and other accrued <br /> <br /> benefits. <br /> <br />Section 5. COMPENSATION <br /> <br /> Employee shall be compensated by Employer <br />according to the ordinance today enacted by City Council' <br />fixing Employee's compensation, the substantive parts of <br />which ordinance are incorporated by reference herein as <br />th6ugh they were set forth herein verbatim. <br /> <br /> <br />
