],64 <br /> <br />TUESDAY, SEPTEMBER 28, 1993 <br /> <br />consecutive meetings to enact the only Ordinance it was empowered to <br />enact by the Legislature regarding this matter and Councilman Williams <br />emphasized that "Council is concerned, but cannot take an action that <br />is not in accordance with the law." Ms. Hylton suggested that Council <br />write a letter to ETS informing them of the problems which the presence <br />of the Company has caused in the community. In response to a question <br />from Vallie Hylton, 402 Second Street, as to what the City Manager <br />could do, City Manager Earl B. Reynolds, Jr. said four options <br />currently exist: (1) the Administration could work with those residing <br />in the property which is immediately adjacent to the R. P. Thomas <br />facility if they obtain title to that property; (2) as directed by the <br />Council, work with members of the General Assembly in strengthening the <br />Ordinance; (3) pursue enforcement of the Ordinance under present <br />conditions, with the understanding that the Ordinance does have defects <br />and may not produce the desired results; and (4) assist a community <br />group in forming a non-profit community development organization which <br />could be organized to obtain grants and donations in order to purchase <br />the R. P. Thomas property. <br /> <br />Upon motion, duly seconded and by unanimous vote, Council adopted, on <br />second reading, the following Ordinance No. 93-15: <br /> <br />BE IT ORDAINED by the Council of the City of Martinsville, Virginia, in <br />regular session assembled on September 28, 1993, that it does hereby <br />amend Chapter 13--Offenses, Section 13-11--Excessive, Unnecessary, <br />Etc., Noise, Subsection (a)(7) of the City Code, as follows: <br /> <br />Sec. 13-11. <br /> <br /> (a) <br /> <br />(7) <br /> <br /> CHAPTER 13 -- OFFENSES <br /> <br /> Excessive, unnecessary, etc., noise. <br /> <br />It shall be unlawful and a Class 1 misdemeanor for any <br />person: <br /> <br />To emit, from any loudspeaker or sound-amplification <br />equipment located in or on any vehicle, trailer, airplane, <br /> <br /> <br />
