],64

TUESDAY, SEPTEMBER 28, 1993

consecutive meetings to enact the only Ordinance it was empowered to
enact by the Legislature regarding this matter and Councilman Williams
emphasized that "Council is concerned, but cannot take an action that
is not in accordance with the law." Ms. Hylton suggested that Council
write a letter to ETS informing them of the problems which the presence
of the Company has caused in the community. In response to a question
from Vallie Hylton, 402 Second Street, as to what the City Manager
could do, City Manager Earl B. Reynolds, Jr. said four options
currently exist: (1) the Administration could work with those residing
in the property which is immediately adjacent to the R. P. Thomas
facility if they obtain title to that property; (2) as directed by the
Council, work with members of the General Assembly in strengthening the
Ordinance; (3) pursue enforcement of the Ordinance under present
conditions, with the understanding that the Ordinance does have defects
and may not produce the desired results; and (4) assist a community
group in forming a non-profit community development organization which
could be organized to obtain grants and donations in order to purchase
the R. P. Thomas property.

Upon motion, duly seconded and by unanimous vote, Council adopted, on
second reading, the following Ordinance No. 93-15:

BE IT ORDAINED by the Council of the City of Martinsville, Virginia, in
regular session assembled on September 28, 1993, that it does hereby
amend Chapter 13--Offenses, Section 13-11--Excessive, Unnecessary,
Etc., Noise, Subsection (a)(7) of the City Code, as follows:

Sec. 13-11.

(a)

(7)

CHAPTER 13 -- OFFENSES

Excessive, unnecessary, etc., noise.

It shall be unlawful and a Class 1 misdemeanor for any
person:

To emit, from any loudspeaker or sound-amplification
equipment located in or on any vehicle, trailer, airplane,
