2136 <br /> <br />TUESDAY, JULY 13, 1993 <br /> <br />Upon motion, duly seconded and by unanimous vote, Council authorized <br />the City Managerto execute an agreement with Henry County for an <br />extension until December 31, 1993 of the agreement with the County for <br />use of the City Landfill. It was noted that (1) the current rate of <br />$16 per ton would be maintained; (2) the extension was conditioned upon <br />the City's ability to continue landfilling through December 31, with no <br />liability for County trash disposal being incurred if the City cannot <br />continue to operate the Landfill for any reason; and (3) any extension <br />beyond December 31 would be treated as a new request rather than an <br />extension of the current agreement and, therefore, the per-ton rate <br />would be adjusted to reflect the cost per ton which will be recommended <br />by the City's consultant who is currently studying this matter. <br /> <br />At this point Mayor McClain removed himself from the discussion and <br />exited the Chamber, stating that the next item to be considered <br />involved Southwestern Virginia Gas Company, of which he is President. <br />Vice-Mayor Adams assumed Chairmanship of the meeting. <br /> <br />In accordance with Section 2.1-344(A) of the CODE OF VIRGINIA (1950, <br />and as amended), and upon motion, duly seconded and by unanimous vote, <br />Council convened into Executive Session for the purpose of consultation <br />with legal counsel, as authorized by Subsection 7, and discussion of <br />the disposition of publicly-held property, as authorized by Subsection <br />3. At the conclusion of this Executive Session, each member of Council <br />certified that (1) only public business matters exempted from open <br />meeting requirements were discussed in said Executive Session; and (2) <br />only those business matters identified in the motion convening the <br />Executive Session were heard, discussed or considered during said <br />Session. <br /> <br /> <br />
