181 <br /> <br />TUESDAY, NOVEMBER 10, 1998 <br />WHEREAS, §58.1-3965 of the Code of Virginia provides that when any taxes on real estate in a city are <br />delinquent on December 31 following the second anniversary of the date on which such taxes have become <br />due that such real estate may be sold for the purpose of collecting all delinquent taxes on said property; and <br /> <br />WHEREAS, §58.1-3968 of said Code provides that two or more parcels of real estate may be covered by <br />one bill in equity where they are owned by different parties provided that each parcel is assessed at a value <br />which does not exceed $1 00,000; and <br /> <br />WHEREAS, all of the hereinafter described parcels are assessed at a value which does not exceed <br />$100,000.00, now, therefore <br /> <br />BE IT RESOLVED by the Council of the City of Martinsville, Virginia, in regular session held on <br />November 10, 1998 that Nita K. Stanley, Attorney at Law, be, and she hereby is, authorized and directed to <br />file a bill in equity in the Circuit Court of the City of Martinsville within the time prescribed by law following <br />the giving of the notices of said sale and the publication of same required by said §58.1-3965 to subject the <br />hereinafter described parcels of real estate to the lien for such delinquent taxes, which real estate is described <br />as follows: <br /> <br />Parcel one: that certain tract or parcel of land known as Lots A, B, C and D located at the <br />end of Allen Street shown on plat of survey for John W. Swanson, prepared by W. C. <br />Brown, dated April 4, 1954, recorded in the City of Martinsville Circuit Court Clerk's <br />Office in Map Book 3, page 119 (Plat Cabinet A-43), and being part of the same property <br />conveyed to John Swanson from Mabel Cunningham, widow, et als, by deed dated March <br />1, 1946 in the Circuit Court Clerk's Office of Henry County, Virginia in Deed Book 79, <br />page 117, to which deed and plat reference is hereby made for a more particular description <br />of the aforesaid tract or parcel of land <br /> <br />Parcels two and three: all those two certain lots or parcels of land, with appurtenances <br />thereunto appertaining, situate on the northwest intersection of Bunk Street and Dalton <br />Street, parcel one being more particularly described as Lot "4D", containing 5,069 square <br />feet more or less, as shown on plat of survey for Harry W. Brown and Cora M. Brown, <br />dated January 31, t986, prepared by J. A. Gustin and Associates, P.E. & M.L.S. and parcel <br />two being more particularly described as all that certain lot, piece or parcel of land with <br />improvements thereon, lying in and being in the City of Martinsville, Lot 47 x 220, North <br />margin Bunk Street, Map #22(1)4C, said lots or parcels of land being the same two parcels <br />conveyed to Robert L. Cooke and Rosemary Cooke, Husband and Wife, from W. R. <br />Broaddus, HI and Charles Williams, Co-Executors of the Estate of Sadye F. Baldwin, <br />deceased by deed dated May 31, 1995 and of record in said Clerk's Office in Deed Book <br />236, at page 474, to which plat, map and deed reference is hereby made for a more <br />particular description of the aforesaid lots or parcels of land. <br /> <br />BE IT FURTHER RESOLVED, that neither the Martinsville City Council nor the City of <br />Martinsville shall be obligated to compensate said attorney for bringing the suit and that her <br />compensation shall be such as is determined by the Circuit Court of the City of Martinsville or by the <br />party who has an interest in the bringing of the suit that is hereby authorized. <br /> <br />BE IT FURTHER RESOLVED, that said attomey be, and she hereby is, directed to report from time <br />to time to Council concerning the status of said suit once it has been filed. <br /> <br /> <br />
