the monthly gross charge to said consumer, and shall not be <br />applicable to any amount so charged in excess of thirty dollars <br />per month for each mobile service consumer, and, <br /> <br />WHEREAS, it is necessary to amend Section 21-90 of the City Code <br />to conform to the amendment to Section 58.1-3812 of the Virginia <br />Code, <br /> <br />NOW THEREFORE, BE IT ORDAINED by the Council of the City of <br />Martinsville, Virginia, in regular session held June 27, 1995 that <br />it does hereby amend the City Code as follows: <br /> <br /> The tax rate shall be twenty percent of the first <br />fifteen dollars (maximum three dollars) for each <br />residential service and twenty percent of the first <br />fifteen dollars plus five percent of any amount in <br />excess of fifteen dollars for each commercial or <br />business service, except that notwithstanding the <br />foregoing, the tax may be imposed only at a rate equal <br />to ten percent of the monthly gross charge to the <br />consumer of mobile local telecommunications and shall <br />not be applicable to any amount so charged in excess of <br />thirty dollars per month for each mobile service <br />consumer. <br /> <br /> Be it further 0RDAINED that an emergency exists, <br />and that this ordinance shall be effective on and after <br />this date. <br /> <br />In a matter not on the agenda, City Manager Earl B. Reynolds, Jr. <br />announced Henry County had proposed to have a joint public hearing on <br />the cable television franchise on September 11, 1995 at 7:00 P.M. at a <br />location to be determined. Upon motion, duly seconded and by unanimous <br />vote, Council agreed to hold the joint public hearing and to hold a <br />public hearing for City residents during the September 12, 1995 regular <br />Council meeting. <br /> <br />At this point the meeting was recessed and reconvened in the Council <br />Chamber, with all members of Council continuing to be present. <br /> <br />In accordance with Section 2.1-344 (A) of the CODE OF VIRGINIA (1950, <br />and as amended) and upon motion, duly seconded and by unanimous <br />recorded vote, Council convened into Executive Session for the purpose <br /> <br /> <br />
